CITY OF LAGUNA HILLSNOTICE INVITING SEALED BIDS FORTERMITE FUMIGATION MAINTENANCE SERVICES NOTICE IS HEREBY GIVEN that sealed bids will be received by the City of Laguna Hills, as AGENCY, for furnishing all materials, equipment, tools, labor, and incidentals as required for the above stated Project in strict accordance with this Notice Inviting Bids, Specifications and Termite Fumigation Maintenance Services Agreement on file in the City Clerk’s Department of the City of Laguna Hills. Bids will be received by the City Clerk at the City of Laguna Hills until 3:00 pm on the 4th day of May 2026, at which time and place the bids will be publicly opened and read aloud. Bids shall be submitted in sealed envelopes marked on the outside, “SEALED BID FOR TERMITE FUMIGATION MAINTENANCE SERVICES AT THE LAGUNA HILLS CIVIC CENTER - DO NOT OPEN WITH REGULAR MAIL.” The determination of the lowest bid value shall be based upon a comparison of the Base Bid only. NON-MANDATORY SITE INSPECTION OPPORTUNITY: Bidders shall be offered the opportunity to inspect the Laguna Hills Civic Center on Thursday, April 23, 2026 at 10:00 a.m. Meet in the Lobby of the Civic Center. Site Address: 24031 El Toro Road, Laguna Hills, California 92653. A City Staff Member will direct and/or escort the Bidders around the Civic Center. Bidders are encouraged to participate in the site inspection opportunityas no changes conditions claims shall be accepted. The City seeks to retain the services of a qualified and experienced company/Proposer capable of performing the work of termite fumigation at the Laguna Hills Civic Center (the “Project”) in accordance with a Base Bid and/or any combination of Alternate Bids. The Agency reserves the right, after opening bids, to reject any or all bids and will procure the services for Project consistent with the City’s procurement regulations, procedures, and best qualified vendor selection criteria set forth in Sections 3-08.090 and 3-08.100 of the Laguna Hills Municipal Code (LHMC), respectively, as determined solely by the City; to waive any informality in the bidding; to accept any bid or portion thereof; and to take all bids under advisement for a period of ninety (90) days. Bids will be compared on the basis of the Engineer’s estimate of the quantities of the several items of work as shown on the bid sheets. A full and complete copy of Sections 3-08.090 and 3-08.100 of the LHMC is provided within the Instructions for Bidders section of this document. To facilitate the City’s determination of the Best Qualified Vendor, Bidder shall provide up to ten pages of additional information about their unique qualifications meeting the City’s needs for this Project as a part of the submission of their Bid Proposal. The City may, at its discretion, after the opening of the Bids, schedule interviews of the lowest Bidders as a part of its determination of the Best Qualified Vendor. Bidders shall be notified of a schedule of interviews and shall participate upon an invitation issued by the City. At the time of award of the proposed Termite Fumigation Maintenance Services Agreement, the Proposer shall possess and maintain: (1) Company Registration, (2) Field Representative, and (3) Operator licenses from the California Department of Consumer Affairs, Structural Pest Control Board. The City requires either the State Compensation Insurance Fund or a carrier rated B+ or above for Workers’ Compensation Insurance. The selected company/Proposer shall enter into the City's Termite Fumigation Maintenance Services Agreement, which includes the following provision regarding Prevailing Wages: “The City has determined that the Work and Services under this Agreement requires work of labor categories which are subject to Prevailing Wage Laws identified in the State of California Labor Code. Proposer is aware of the requirements of California Labor Code Section 1720, et seq., and 1770, et seq., as well as California Code of Regulations, Title 8, Section 16000, et seq., (“Prevailing Wage Laws”), which require the payment of prevailing wage rates and the performance of other requirements on “public works” and “maintenance” projects. Proposer agrees to fully comply with all applicable federal and state labor laws (including, without limitation, if applicable, the Prevailing Wage Laws). It is agreed by the Parties that, in connection with the Work or Services provided pursuant to this Agreement, Proposer shall bear all risks of payment or non-payment of prevailing wages under California law, and Proposer hereby agrees to defend, indemnify, and hold the City, its elected officials, officers, employees, and agents free and harmless from any claim or liability arising out of any failure or alleged failure to comply with the Prevailing Wage Laws. The foregoing indemnity shall survive termination of this Agreement.” Except for any work or services that are considered to be cleaning, custodial, and janitorial in nature, the City has determined that the work or services contemplated herein are Public Works as defined in the State of California Labor Code, therefore such work or services shall be subject to compliance monitoring and enforcement by the Department of Industrial Relations (DIR). The prevailing wages applicable to this procurement are available on the DIR web page at www.dir.ca.gov. It is the Bidders’ sole responsibility to incorporate the cost of complying with all prevailing wage and labor compliance requirements and all applicable laws for this Project. The successful Bidder and its sub-Proposers of any tier, if any, shall maintain active registration with DIR, as appropriate, for the duration of this Project. Additional Prevailing Wage requirements are set forth in more detail as terms and conditions in the attached (see Appendix I) Sample Draft Termite Fumigation Maintenance Services Agreement, which is subject to change upon final.
