MARIN COUNTY DEPARTMENT OF PUBLIC WORKS SAN RAFAEL, CALIFORNIA NOTICE TO BIDDERS INVITING SEALED PROPOSALS OF BIDS *************************************** Notice is hereby given by order of the Marin County Board of Supervisors, that the Director of Public Works will receive bids for: Project Name: McGlashan Pathway Repair County Project No. 2022-21 Bid Opening Date: March 24th, 2026, at 2:00 PM Zoom Meeting ID: 824 4508 8015, Password: DPWENG2026 https://us05web.zoom.us/j/82445088015?pwd=HPdRJ0aZBymegr4rLwlqwuHb0aKVye.1 Bids must be submitted electronically through Bid Express®, or by submitting sealed paper bids to the Director of Public Works via the administration desk at 3501 Civic Center Drive, Suite 304, San Rafael, CA 94903, on or before the date and time noted above, at which time bids will be publicly opened and read aloud on Zoom; Zoom meeting details noted above. The Marin County Department of Public Works has transitioned its bidding processes to the Bid Express® online platform. Bidders can access current solicitations and a how-to guide for first time Bid Express users by visiting the County of Marin Bid Express home page at https://www.bidexpress.com/businesses/53528/home. Once registered with Bid Express, bidders will be able to view project solicitations, download bid documents, view and add themselves to the plan holders' list, and submit requests for information. Project Description: The project will include pathway improvements to current Americans with Disabilities Act (ADA) standards on each end of the pedestrian bridge at McGlashan Pathway. McGlashan Pathway is heavily used and must remain open during daytime hours. All construction activities shall be conducted during nighttime hours, and the contractor shall ensure that the pathway remains fully accessible to the public during daytime hours. The Engineer's estimate for this project is $95,000. Bids are required for the entire work described herein. The Contractor shall possess a valid Class "A" License at time of bid submittal. To bid on this Project, the Bidder and all subcontractors are required to be registered as a public works contractor with the Department of Industrial Relations pursuant to the Labor Code. The Bidder's and all subcontractors' registration must remain active throughout the term of the Contract. A Bid Bond, cash, certified check, or cashier's check, in the amount of 10% of the total bid amount payable to the County of Marin shall accompany the Proposal. The Board of Supervisors of the County of Marin reserves the right to reject any or all bids and the right to waive any irregularities. Award of contract, if awarded, will be to the lowest responsible bidder whose proposal complies with prescribed requirements, and will be within sixty (60) days after the date of the Bid Opening. The County may extend the specified award period if the Bidder agrees. If the Bidder does not receive a request to extend the bid date, or receives a request but does not accept a County request to extend the bid date, before 4:00 on the last day of the award period: 1. Your bid becomes invalid 2. You are not eligible for the award of the contract At the successful Contractor's option, securities may be substituted for the required retention, in accordance with the provisions of Section 22300 of the State of California Public Contract Code. Pursuant to Public Contract Code Sections 7201 and 9203, the County of Marin shall retain 5 percent of the contract price until final completion and acceptance of the project. This project is to be advertised pursuant to Public Contract Code 22034. There is no pre-bid meeting scheduled for this project. Questions concerning the Bid should be submitted via Bid Express no later than 5 p.m. on Wednesday, March 18th, 2026. Inquiries or questions based on alleged patent ambiguity of the plans, specifications or estimate must be communicated as a bidder inquiry prior to bid opening. Bidder must visit the work site before submitting a bid. Bidder shall thoroughly investigate the conditions which will be encountered in the project including, but not limited to, existing retaining wall, existing underground and overhead utilities, existing structures at the private property, road width, space needed to flag traffic, existing Asphalt Concrete and Concrete Paver conditions, staging, pedestrian access, detouring, and site access challenges. This contract is subject to state contract nondiscrimination and compliance requirements pursuant to Government Code, Section 12990. The County of Marin hereby notifies all bidders that it will affirmatively insure that in any contract entered into pursuant to this advertisement, disadvantaged business and woman owned business enterprises will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color or national origin in consideration for an award. This is a public works contract subject to the provisions of Part 7 of Division 2 of the California Labor Code (Sections 1720 et seq.). In accordance with Labor Code Section 1771, Contractor and all subcontractors shall pay not less than current prevailing wage rates as determined by the California Department of Industrial Relations ("DIR") to all workers employed on this project. Pursuant to Section 1773 of the California Labor Code, the general prevailing wage rates for Marin County where the work is to be done have been determined by DIR. These wages are set forth in the General Prevailing Wage Rates for this project, available at the Department of Public Works. Prevailing Wage rates are also available at the State of California Division of Labor Statistics and Research website: http://www.dir.ca.gov/DLSR/PWD/index.htm In accordance with Labor Code Section 1815, Contractor and all subcontractors shall pay all workers employed on this project 1 1/2 the basic rate of pay for work performed in excess of specified hour limitations. The work performed pursuant to this agreement is subject to compliance monitoring and enforcement by the Department of Industrial Relations. California Labor Code Sections 1777.1, 1775, and 1813, describe potential penalties contractors or subcontractors may be subject to for failure to comply with the prevailing wage law. Equipment rental rates as determined by the State of California are listed in the Department of Transportation publication entitled "Labor Surcharges and Equipment Rental Rates," issued semi monthly. The U.S. Department of Transportation (DOT) provides a toll-free "hotline" service to report bid rigging activities. Bid rigging activities can be reported Mondays through Fridays, between 8:00 A.M. and 5:00 P.M., eastern time, Telephone No. 1-800-424-9071. Anyone with knowledge of possible bid, bidder collusion, or other fraudulent activities should use the "hotline" to report these activities. The "hotline" is part of the DOT's continuing effort to identify and investigate highway construction contract fraud and abuse and is operated under the direction of the DOT Inspector General. All information will be treated confidentially, and caller anonymity will be respected.
