NOTICE INVITING BIDS NOTICE IS HEREBY GIVEN that the City of Hesperia will receive online sealed bids on or before 10:00 a.m. on Thursday – March 19, 2026 via the “PUBLIC PURCHASE” web site for the construction of the public works project identified as FY 2024-25 CDBG Street Improvements –C.O. No. 7175. CDBG funds will be used for this project. The scope of work generally consists of pavement rehabilitations and reestablishment of pavement delineations and pavement markings on mostly residential roads. The Work is to be done in accordance with the project’s Plans and the Contract Documents and Specifications and as directed by the City Engineer. The specific Work to be done under each Bid Item is described in Chapter VII – Technical Provisions via narratives. Questions or clarifications concerning the scope of work shall be submitted prior to the deadline. The Engineer’s Estimate of Probable Costs is around $1.7 Million and the time for completion of the work shall be thirty (30) working days. The plans and Contract Documents and Specifications for this project are available online for download through the PUBLIC PURCHASE website directly at www.publicpurchase.com. Bids shall be submitted in conformance with the Contract Documents and Specifications as provided by the Engineering Division of the city of Hesperia. Bid and accompanying documents must be submitted electronically through PUBLIC PURCHASE. PUBLIC WORKS CONTRACTOR AND SUBCONTRACTOR REGISTRATION: Pursuant to California Labor Code Division 2, Part 7, Chapter 1, Article 2, a contractor or subcontractor shall not be qualified to bid on, be listed in a bid proposal, or engage in the performance of any contract for public work with the City of Hesperia, as defined in said chapter, unless currently registered with the California Department of Industrial Relations and qualified to perform public work pursuant to Labor Code § 1725.5 [with limited exceptions from this requirement for bid purposes only under Labor Code § 1771.1(a)]. It is not a violation of this section for an unregistered contractor to submit a bid that is authorized by § 7029.1 of the Business and Professions Code or by §§ 10164 or 20103.5 of the Public Contract Code, provided the contractor is registered to perform public work at the time the contract is awarded. All Bidders and their subcontractors (that are listed on – List of Proposed Subcontractors or Sub-Tier Contractors) shall provide an extract from the Public Works Contractor Registration web site with their submitted bid providing evidence of active registration with the Labor Commissioner. For purposes of Labor Code § 1781, this Project is a “public work” to which Labor Code § 1771 applies, and the Contractor and all listed or unlisted subcontractors must perform the work as a “public work.” The Contractor has the responsibility for determining what is required to comply with its obligations under Labor Code § 1771. Any decision by the Contractor or any listed or unlisted subcontractor not to comply with Labor Code § 1771 is at the sole risk of the Contractor or subcontractor. NOTICE IS HEREBY GIVEN that this project is a public work in the State of California, funded in whole or in part with public funds. Under the provisions of California Labor Code, Division 2, Part 7, Chapter 1, Articles 1 and 2, the contractor and any subcontractor under the contractor is required to pay not less than the general prevailing rate of per diem wages to all workers employed in the performance of work under this project and for any work of a similar character in the locality in which the public work is performed, including the general prevailing rate of per diem wages for holiday and overtime work. The Contractor’s duty to pay State prevailing wages can be found under Labor Code § 1770 et seq. Pursuant to § 1773 of the Labor Code, the Director of the California Department of Industrial Relations (DIR) has determined such general prevailing rates of per diem wages. The State Wage Decision is on file at the Development Services Department at City Hall, 9700 Seventh Avenue, Hesperia, California and is available to any interested party upon request; or may be obtained online from the DIR website at http://www.dir.ca.gov/dlsr/. The contractor shall cause a copy of said determinations to be posted at the job site. The contractor shall be subject to the penalty forfeiture provisions of the Labor Code for violations by the contractor or any subcontractor under him. Future effective general prevailing wage rates, which have been predetermined and are on file with the California Department of Industrial Relations are referenced but not printed in the general prevailing wage rates. Labor Code §§ 1775, 1777.1, 1777.7, and Cal. Pub. Contract Code § 6109 outlines the penalties for failure to pay prevailing wages and to employ apprentices, including forfeitures and debarment. Any bid submitted by a contractor or subcontractor that is ineligible to bid on a public work pursuant to these codes shall be rejected. The California Department of Industrial Relations publishes a list of debarred contractors online at . U.S. HOUSING AND URBAN DEVELOPMENT (HUD) PREVAILING WAGE STATEMENT: This contract will be funded in whole or in part with federal housing and community development funds. The Federal Labor Standards Provisions, including prevailing wage requirements of the Davis-Bacon and Related Acts will be enforced. A copy of the Federal Wage Decision applicable to this project is included herein. This project is also a public work in the State of California, funded in whole or in part with public funds. Therefore, the higher of the two applicable prevailing wage rates, federal or state, will be enforced. The City of Hesperia will not accept lower State wage rates not specifically included in the Federal minimum wage determinations. This includes "helper" (or other classifications based on hours of experience) or any other classification not appearing in the Federal wage determinations. Where Federal wage determinations do not contain the State wage rate determination otherwise available for use by the Contractor and subcontractors, the Contractor and subcontractors shall pay not less than the Federal minimum wage rate, which most closely approximates the duties of the employees in question. ELECTRONIC CERTIFIED PAYROLLS are required to be submitted during the term of construction. Payment of contractor’s invoice may be delayed when certified payrolls are not submitted in accordance with the California Labor Code. The City shall make progress payments on any properly completed payment request submitted by the Contractor. The payment request shall not be deemed properly completed unless certified payrolls have been properly completed and submitted on a weekly basis, for each week worked during the time period covered by said payment request. All Contractors and Subcontractors performing work on this project shall be required to furnish electronic certified payroll records directly to the Labor Commissioner (i.e., California Department of Industrial Relations - Division of Labor Standards Enforcement). The awarded Contractor shall post jobsite notices as prescribed by regulations. This project is subject to compliance monitoring and enforcement by the Department of Industrial Relations. APPRENTICESHIP PROGRAM: Attention is directed to Sections 1777.5, 1777.6 and 1777.7 of the California Labor Code and Title 8, California Administrative code, Section 200 et seq. to ensure compliance and complete understanding of the law regarding apprentices. WORKING HOURS: The Contractor and any subcontractor under him/her shall comply with and be governed by the laws pertaining to working hours as set forth in Division 2, Part 7, Chapter 1, Article 3 of the Labor Code, as amended. The Contractor shall forfeit, as a penalty to the City of Hesperia, $25.00 for each laborer, workman, or mechanic employed in the execution of the Contract, by him/her or any subcontractor under him/her, upon any of the work herein before mentioned, for each calendar day during which said laborer, workman, or mechanic is required or permitted to labor more than 8 hours in violation of said Labor Code. Contractor shall pay travel and subsistence pay pursuant to Labor Code § 1773.8. MINORITY AND WOMEN OWNED BUSINESS: Bidders will be required to document their status as a Minority Business Enterprise (MBE), a Women-owned Business Enterprise (WBE) or a non-MBE/WBE firm. Bidders that are non-MBE/WBE firms will be required to make a Good Faith Effort (GFE), and to document their efforts, to subcontract with MBE/WBE firms as part of the contract bid. The City hereby affirmatively ensures that all business enterprises will be afforded full opportunity to submit bids in response to this Notice and will not be discriminated against on the grounds of race, creed, color, or national origin in any consideration leading to the award of contract. SECTION 3 STATEMENT: This is a HUD Section 3 covered project. Section 3 projects means housing rehabilitation, housing construction, and other public construction projects assisted under HUD programs that provide housing and community development financial assistance when the total amount of assistance to the project exceeds a threshold of $200,000. The threshold of $100,000 where the assistance is from the Lead Hazard Control and Healthy Homes programs, as detailed in 24 CFR 75(a)(2)(i). The project is the site or sites together with any building(s) and improvements located on the site(s) that are under common ownership, management and financing. Build America, Buy America: The construction services performed pursuant to this contract are subject to the Build America, Buy America Act (BABA) requirements under Title IX of the Infrastructure Investment and Jobs Act (“IIJA”), Pub. L. 177-58. Absent an approved waiver, all iron, steel, manufactured products, and construction materials used in this project must be produced in the United States, as further outlined by the Office of Management and Budget’s Memorandum M-22-11, Initial Implementation Guidance on Application of Buy America Preference in Federal Financial Assistance Programs for Infrastructure, April 18,2022. By submitting a bid, Contractor hereby certifies they are familiar with all laws and regulations that may affect cost, progress, and performance of the work, including BABA requirements. A copy of the contractor self-certification form is included in the Bid Document. CONFLICT OF INTEREST: In the procurement of supplies, equipment, construction, and services, the conflict of interest provisions in 2 CFR 200.318 shall apply. No employee, officer, or agent may participate in the selection, award, or administration of a contract supported by a Federal award if he or she has a real or apparent conflict of interest. Such a conflict of interest would arise when the employee, officer, or agent, any member of his or her immediate family, his or her partner, or an organization which employs or is about to employ any of the parties indicated herein, has a financial or other interest in or a tangible personal benefit from a firm considered for a contract. The officers, employees, and agents of the nonFederal entity may neither solicit nor accept gratuities, favors, or anything of monetary value from contractors or parties to subcontracts. ALONG WITH THEIR BID, BIDDERS MUST SUBMIT cash, a cashier’s check, a certified check, or a bidder’s bond, payable to the City of Hesperia in an amount equal to at least ten percent (10%) of the bid, as a guarantee that the Bidder will enter into the contract if the same is awarded to the successful bidder, and in event of failure to enter into such contract said cash, cashier’s check, certified check, or bond shall become the property of the City of Hesperia. If the City of Hesperia awards the contract to the next lowest Bidder, the amount of the lowest Bidder’s security shall be applied to the difference between the low bid and the second lowest bid, and the surplus, if any, shall be returned to the lowest Bidder. The three (3) apparent lowest bidders shall submit their original wet-signed bidder’s bond, or other form of original bidder’s security, to the City either in person or via U.S. Mail within three (3) working days after the date of the online bid opening. Failure of any of these bidders to submit an original of their bidder’s security within the stipulated deadline shall be cause for rejection of their bid. The successful Bidder shall be required to post a Performance Bond in the amount of one hundred percent (100%) of the contract price and a Payment Bond (Labor and Materials Bond) equal to one hundred percent (100%) of the contract price. Sureties shall meet all of the State of California bonding requirements in accordance with the Code of Civil Procedure (§ 995.120) and be admitted by the State of California. Except as required by California Public Contract Code § 20103.5 - Federal Funded Projects, no bid will be considered from a contractor who is not licensed at the time of bid opening as a Class A: General Engineering Contractor or an applicable Class C Specialty License. The contractor may, upon request and at the sole expense of the contractor, substitute authorized securities in lieu of monies withheld (performance retention) by the City. The successful bidder will be required to enter into a contract satisfactory to the City of Hesperia. The City reserves the right to reject any or all bids or any part(s) thereof, to waive any irregularities or informalities in any bid or in the bid process, and to make a contract award in the best interest of the City. 02/18, 02/25, 2026
