NOTICE OF INITIATION OF FORFEITURE PROCEEDINGS Pursuant to Health & Safety Code § 11470 et seq. To: JUAN AYALA BARRAJAS 6237 YOSEMITE BLVD. MODESTO, CA 95357 And ALL INTERESTED PARTIES. Notice is hereby given that a petition for the forfeiture of certain specified property in the amount of FORTY ONE THOUSAND TWO HUNDRED SEVENTY SIX DOLLARS AND FORTY THREE CENTS IN U.S. CURRENCY ($41,276.43) seized on October 04, 2024, pursuant to California Health & Safety Code § 11470 et seq., has been filed in the Superior Court of San Joaquin County. Any interested party may file a claim with the Superior Court stating the nature and extent of his or her claimed interest in the property. The claim must be verified and filed with the Court Clerk within 30 days from the date of receipt of this notice or within 30 days from the last publication of this notice. Address of the Court: Superior Court, San Joaquin County 180 E. Weber Avenue Room 200 Stockton, California 95202 An endorsed copy of the claim must also be served on the District Attorney’s Office at 222 E. Weber Avenue, Room 101, Stockton, California 95202. Where a contested hearing is held, a claimant with standing has the following rights, which include but are not limited to: the use of the subpoena powers of the court and to order witnesses to attend, testify on one’s own behalf, submit evidence showing the legitimacy of the seized assets, and the right to cross examine the petitioner’s witnesses. Since this is a civil action, a claimant with standing has also the right to represent himself or herself or hire his or her own attorney. There is no right to an appointed counsel in this case. If no claim is properly filed within the time allowed, the petitioner will move to have the property ordered forfeited to the State, to be disposed of according to law.
