Official No. 1268816, AND ALL OF HER ENGINES, TACKLE, ACCESSORIES, EQUIPMENT, FURNISHINGS, CARGO, AND APPURTENANCES, in rem; and MARLUV CHARTERS, LLC, a California Limited Liability Company; and KRISTOPHER GOMEZ, an individual, pursuant to Orders of the United States District Court dated November 4, 2025 and November 26, 2025, the United States Marshal hereby gives notice that, M/Y MARLUV, a 64.8-Foot 2016 Galeon Motor Yacht, U.S.C.G. Official No. 1268816, AND ALL OF HER ENGINES, TACKLE, ACCESSORIES, EQUIPMENT, FURNISHINGS, CARGO, AND APPURTENANCES, in rem, and other property belonging thereto, will be sold free and clear of all liens, as is, where is, in accordance with Rule (E)(9)(b) of Supplemental Rules for Admiralty or Maritime Claims and Asset Forfeiture Actions and Civil Local Admiralty Rule E.15 at public auction on the 10th day of March, 2026, beginning at 12 noon. The sale will be conducted at Island Yacht Anchorage, 1500 Anchorage Rd, Wilmington, CA 90744. The last and highest bidder at the sale will be required to deposit with the U.S. Marshal or the Registry of the Court a certified check or cashier's check, of the full purchase price if it does not exceed $500 and otherwise $500 or ten percent (10%) of the bid, whichever is greater, and that the balance, if any, of the purchase price shall be paid by certified check or cashier's check before confirmation of the sale or within seven (7) days of the dismissal of any opposition which may have been filed, exclusive of Saturdays, Sundays, and legal holidays. Any proceeds of the sale shall be held by or deposited by the United States Marshal in the Registry of the Court, pending further Order of the Court. Plaintiff shall be authorized to credit bid at the sale without cash in an amount of up to $1,006,679.29, as specified in the Court's Orders of November 4, 2025 and November 26, 2025, plus additional interest and late charges accruing thereafter pursuant to the Promissory Note attached to Plaintiff's Verified Complaint until Defendant M/Y Marluv is sold, Substitute Custodian fees and other custodia legis expenses accrued until the Defendant M/Y Marluv is sold, the $405 filing fee paid to the Clerk of the Court, actual United States Marshal fees, and attorney fees, or such other total as established by the affidavit required by Local Admiralty Rule E.15(b) that is consistent with the Courts Orders. Should Plaintiff elect to credit bid, it shall file and serve all parties with its affidavit establishing the total amount of its secured indebtedness no later than fourteen (14) days prior to the date of the sale, as required by Local Admiralty Rule E.15(b). Pursuant to Local Admiralty Rule E. 15c, if within seven (7) days of the auction date, no written objection to the sale of the Defendant Vessel is filed, the sale shall stand confirmed as of course, without the necessity of any affirmative action thereon by a judge, except that no sale shall stand confirmed until the buyer has complied fully with the terms of the purchase. Objections to confirmation of sale properly and timely filed will be adjudicated by the Court. Any objecting party shall serve copies of written objections to all known and interested parties, said parties to include the United States Marshal and the purchaser, and shall further do all things required by Local Admiralty Rules of the U.S. District Court for the Central District of California.
