UNITED STATES DISTRICT COURTSOUTHERN DISTRICT OF CALIFORNIACase No.: 3:26-cv-1860-AGS-MSB NOTICE OF COMPLAINT FOR EXONERATION FROM, OR LIMITATION OF, LIABILITY In the matter of the Complaint of BAD BEHAVIOR, LLC, as the owner of the 44’ Beneteau First 44.7 “BAD BEHAVIOR,” and her engines, tackle, appurtenances, etc. For Exoneration from, or Limitation of, Liability. NOTICE IS HEREBY GIVEN that BAD BEHAVIOR, LLC (“PLAINTIFF-IN-LIMITATION”), as the owner of the motor vessel “BAD BEHAVIOR,” a 2025 44’ Beneteau First 44.7 bearing Primary Vessel No. 1254815 and Hull Identification No. BEYD5099A505, and her engines, tackle, appurtenances, etc. (the “Vessel”), has filed a Complaint in Admiralty for Exoneration from, or Limitation of, Liability (the “Complaint”) claiming the right to exoneration from, or limitation of, liability under the Limitation of Liability Act of 1851, 46 U.S.C. §§ 30501, et seq., for all claims arising out of, resulting from, or in any way connected with the incident on September 21, 2025, on navigable waters of the United States, in the waters of San Diego Bay, which connects, unimpeded, to the Pacific Ocean, in San Diego, San Diego County, California, as alleged and for the reasons and circumstances set forth in the Complaint. NOTICE IS FURTHER GIVEN that all individuals and entities asserting claims with respect to the Complaint for Exoneration from, or Limitation of, Liability must appear and answer the allegations of the Complaint, and file their claims, as provided in Rule F(5) of the Supplemental Rules for Admiralty or Maritime Claims and Asset Forfeiture Actions, with the Clerk of this Court at the Edward J.
