Public Notice: 3900 Thornton Ave. Dept. of Toxic Substances Control __________________________________________________________________________ Land Use Covenant (LUC) Announcement __________________________________________________________________________ This LUC will restrict uses of the subject property due to presence of hazardous substances in the subsurface. The Department of Toxic Substances Control (DTSC) is placing a LUC at 3900 Thornton Avenue, Fremont, California 94536 (Site). The Site is about 1.05-acres located south of the intersection of Thornton Avenue and Post Street. It is identified by Assessor's Parcel Number (APN) 501-1426-037. The Site has been vacant since 2009 and was formerly occupied by an automotive repair facility and residential land use. The proposed Site redevelopment plan is to build a multi-family affordable residential housing complex. Why is DTSC Involved? Under DTSC oversight, soil vapor confirmation monitoring was done every three months for two consecutive years, starting in late 2023 and ending in mid-2025. This monitoring was needed because a former dry cleaner located at 37070 Fremont Boulevard (Centerville property), may have affected the Site. That property had a release of tetrachloroethylene (PCE) which affected both soil vapor and indoor air at the Centerville property. The San Francisco Bay Regional Water Quality Control Board (SFB RWQCB) managed cleanup at the Centerville property (Case Number 01S0627), and closed the case on June 17, 2025. What does the Land Use Covenant do? The LUC protects people and the environment by limiting certain uses of the Site. It prohibits sensitive uses, such as: Residences on or below the first floor of any building Hospitals Schools Day care centers Any work that disturbs the soil at the Site must follow the Soil Management Plan (SMP), approved by DTSC on January 13, 2026.
