AMERICAN CANYON FIRE PROTECTION DISTRICT NOTICE OF PUBLIC HEARING On Tuesday, April 28, 2026, at the hour of 6:30 p.m., at 4381 Broadway, Suite 201 (in the Council Chambers of the City of American Canyon City Hall), a public hearing will be held by the Board of Directors of the American Canyon Fire Protection District ("District") to consider the following: PROJECT: Consider a Resolution of Formation of the "American Canyon Fire Protection District Community Facilities District No. 1 (Giovannoni Logistics Park) and levy of Special Tax under the Mello-Roos Community Facilities Act of 1982 (California Government Code Section 53311 et. seq.) Napa County, California. PROJECT DESCRIPTION: In order to finance necessary public services to support the development demands of the Giovannoni Logistics Park development in American Canyon, affected property owners proposed establishing a Community Facilities District (CFD) within the District. The territory proposed for the CFD is currently owned by a single landowner. The authorized services to be funded by the CFD include: 1. Fire Protection and Suppression services as outlined in Health and Safety Code Section 13862. 2. Miscellaneous costs related to the above services, including but not limited to planning, engineering, legal, and District and County administration costs. The Resolution of Formation would include the formation of the CFD and imposition of an annual special tax ("Special Tax") to be levied within the CFD to cover the costs of services. This tax will be secured by a continuing lien against all non-exempt real property in the CFD and collected in the same manner as ordinary ad valorem property taxes or through other methods determined by the Board or its designee, including direct billing of affected property owners. At the public hearing the Board will consider and finally determine whether the public interest, convenience and necessity require the formation of the CFD and the levy of the Special Tax. All documents related to the proposed CFD and Special Tax are available for review at the address indicated below. Testimony concerning the extent of the CFD and the furnishing of the particular types of Services will be heard and protests will be considered from registered voters residing within the CFD and persons owning real property within the CFD. At the hearing, the testimony of all interested persons or taxpayers for or against the establishment of the CFD, the extent of the CFD or the furnishing of the specified Services will be heard. Any person interested may file a protest in writing as provided in Section 53323 of the Act. If 50% or more of the registered voters, or six registered voters, whichever is more, residing in the territory proposed to be included in the CFD, or the owners of one-half or more of the area of land in the territory proposed to be included in the CFD and not exempt from the special tax, file written protests against the establishment of the CFD and the protests are not withdrawn to reduce the value of the protests to less than a majority, the Board shall take no further action to create the CFD or levy the special taxes for a period of one year from the date of decision of the Board, and if the majority protests of the registered voters or landowners are only against the furnishing of a type or types of Services within the CFD, or against levying a specified special tax, those types of Services or the specified special tax will be eliminated from the proceedings to form the CFD. The proposed voting procedure shall be by special mail or hand-delivered ballot to the property owners within the territory proposed to be included in the CFD. ENVIRONMENTAL REVIEW: The action before the Board is exempt from review under the California Environmental Quality Act ("CEQA"), consistent with CEQA Guidelines Section 15320, which exempts special district reorganizations and changes in organizations that do not change the geographic area in which the previously existing powers were exercised. PROJECT LOCATION: American Canyon, Napa County, CA APPLICANT: American Canyon Fire Protection District All interested persons are invited to attend the meeting and be heard on this matter. Copies of all documents that relate to the above-described action may be examined at District Office at 911 Donaldson Way, American Canyon, CA 94503 office prior to the hearing. The meeting will be conducted in person and by teleconference via a Zoom connection where the District and staff will participate with both audio and video presence. The meeting will be accessible for all members of the public to attend via the District's website, YouTube, and Cable TV Channel 28 and public comments enabled via email and phone.
