A BILL FOR ORDINANCE NO. 3, SERIES OF 2026 AN ORDINANCE OF THE CITY OF CA¥ON CITY AMENDING TITLE 9, DIVISION V OF THE CA¥ON CITY MUNICIPAL CODE CONCERNING CITY PARKING OPERATIONS WHEREAS, the City desires to establish parking lot hours for the safety and well-being of the community. NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF CA¥ON CITY: Section 1. Title 9, Division V of the Ca¤on City Municipal Code is hereby amended with the addition of a new Chapter 9.47 as follows: Chapter 9.47 PUBLIC PARKING LOTS Sec. 9.47.010. Application of Chapter provisions. The provisions of this Chapter shall apply to all parking lots owned by the City, except as otherwise specifically provided in this Chapter. Sec. 9.47.020. Hours of operation. A. General rule. The City Administrator shall set the hours of operation for City-owned parking lots. Except as otherwise provided in this Chapter, no person who is not an authorized invitee, permittee, agent or employee of the City shall enter into or remain in any such City-owned parking lot at any other time. B. Extended hours. The City Administrator is authorized to issue written parking lot use permits extending the hours during which any such parking lot may remain open for special events. C. Temporary Closures. The City Administrator, or his or her designee, is authorized to order the temporary closure of any City-owned parking lot, or sections thereof, to use by the general public, with or without advance notice, when it has been determined that: 1. The closure is necessary to protect members of the public from possible injury due to actual or anticipated circumstances or conditions; 2. The closure is necessary to protect the facilities within a City-owned parking lot from damage or destruction due to actual or anticipated circumstances or conditions; 3. The closure is necessary to facilitate maintenance or repairs; or 4. The closure is warranted because the City-owned parking lot has been reserved for use by authorized persons, teams or organized groups, or other special events authorized by City Council or the City Administrator pursuant to resolution, contract, agreement, or permit. Sec. 9.47.030. Enforcement authority. It shall be the duty of any Police Department or any person designated by the City Administrator to enforce the rules and regulations set out in this Chapter. Sec. 9.47.040. ViolationPenalty. Any person who violates any provision of this Chapter 9.47 is guilty of a misdemeanor and, upon conviction thereof, shall be punished by a fine in an amount that does not exceed the maximum fine provided for in Section 1.28.010. Section 2. Severability. If any section, subsection, paragraph, clause or other provision of this Ordinance for any reason is held to be invalid or unenforceable, the invalidity or unenforceability of such section, subsection, paragraph, clause or other provision shall not affect any of the remaining provisions of this Ordinance, the intent being that the same are severable. Section 3. Effective Date.
