NOTICE OF SALE OF JUDGMENT AGAINST THE DEER FUND, LLC
HON. ALAN S. FINE (RET.) solely in his capacity as the Court-appointed Receiver in SEND ENTERPRISES, LLC v. SET DRIVE, LLC, et al., Case No. 2023-014668-CA-01, Miami-Dade County Circuit Court, 11th Judicial Circuit, under Court authority, gives notice of the sale of all of Send Enterprises, LLC's right, title, and interest in and to the Default Final Judgment entered on September 4, 2025, in Send Enterprises, LLC and Drive Development Group, LLC v. The Deer Fund, LLC, Case No. 2025-010471-CA-01 (the "Judgment"), in the total amount of $2,611,396.14, plus accruing post-judgment interest, including but not limited to: (a) the principal amount of the Judgment; (b) all accrued and unpaid post-judgment interest; (c) all costs and attorneys' fees awarded in connection with the Judgment; (d) any and all liens arising from or related to the Judgment; and (e) all rights to enforce, collect, execute upon, or otherwise realize upon the Judgment (collectively, the "Judgment Assets"), pursuant to the Bid Procedures approved by the Honorable Thomas J. Rebull on April 15, 2026. The Judgment Assets shall be sold on an "as is, where is" basis, without any representations or warranties of any kind, express or implied, including without limitation any warranty as to collectability, enforceability, or value. Pursuant to the Bid Procedures, the Receiver's counsel will make available to prospective bidders documents and information reasonably requested to evaluate the Judgment, subject to execution of a confidentiality and/or non-disclosure agreement. A form of Purchase and Sale Agreement for Judgment approved by the Court will be made available to all interested potential bidders. Bids must be in writing and in substantial conformity with the form of Purchase and Sale Agreement approved by the Court, and must not be subject to any contingency other than the Court's approval of the sale. All bids must be received by 11:59 p.m. prevailing Miami, Florida time on May 20, 2026  the twentieth (20th) day after the first date of publication of this Notice.
