Notice of Action - Miscellaneous United States District Court Middle District of Florida Jacksonville Division In Admiralty NO. 3:26-cv-190-MMH-PDB IN THE MATTER OF AFFORDABLE BOATING OF NORTH FLORIDA, LLC, AS TITLED OWNER, & CONSTANCE ANNETTE KOONCE, AS OWNER PRO HAC VICE, OF THE 2023 21 BENNINGTON MARINE PONTOON BOAT BEARING HULL IDENTIFICATION NUMBER ETWN9873E323 AND FLORIDA REGISTRATION FL 5936TN, TOGETHER WITH HER ENGINE, TACKLE, APPURTENANCES, EQUIPMENT, ETC., IN A CAUSE FOR EXONERATION FROM OR LIMITATION OF LIABILITY, Notice of Action for Exoneration From, or Limitation of, Liability Vessel: 2023 21 Bennington Marine Pontoon Boat, Hull Identification No. ETWN9873E323 and Florida Registration FL 5936TN, its Engine, Tackle, Appurtenances, Equipment, etc. All potential claimants: Affordable Boating of North Florida, LLC, as titled owner of the vessel, and Annette Koonce, as owner pro hac vice of the vessel, have filed an action in federal court for exoneration from, or limitation of, liability for any claims arising out of an August 13, 2024, event in Florida territorial waters on the 6 Mile Creek near Sawgrass, St. Johns County, Florida. By June 1, 2026, all potential claimants must file and serve any claim with the Clerk of the Court, 300 N. Hogan St., Ste. 9-150, Jacksonville, FL 32202, as required by Rule F(5), Supplemental Rules for Admiralty or Maritime Claims and Asset Forfeiture Actions. Each claimant must also serve a copy of the claim on the plaintiffs lead counsel, Krista Fowler Acuna, Hamilton, Miller & Birthisel, LLP, 150 SE 2nd Ave., Ste. 1200, Miami, FL 33131. Any claim not filed and served by June 1, 2026, will be defaulted. Any claimant who contests the plaintiffs right to exoneration from, or limitation of, liability must file an answer to the complaint as required by Rule F(5) and mail (or serve in another appropriate manner) a copy of the answer to the plaintiffs lead counsel.
