YOU ARE HEREBY COMMANDED to serve this Summons to Show Cause and Notice of Eminent Domain Proceedings and Notice of Petition Date, together with copies of the Petitioner's Petition, Notice of Service of Interrogatories, Interrogatories to Defendant, First Request for Production and Declaration of Taking in this cause upon the following:

(d) And against all persons and parties claiming or having any interest or claim as owners, mortgagees, judgment creditors, lienholders, lessees, or occupants of, upon or against the parcel of land hereinafter described, and respectfully represents and alleges as follows:

1.Miami-Dade County, a political subdivision of the State of Florida, has filed a Petition in County Eminent Domain Proceedings against you and each of you seeking to condemn fee simple title to the parcel hereinafter described, the said lands and interest to said lands lying and being in Miami-Dade County, Florida, is needed for right-of-way needed for "Improvements to Harriet Tubman Highway from NE 164 Street to NE 173 Street in the City of North Miami Beach," and more particularly described as follows:


LEGAL DESCRIPTION
(FEE SIMPLE)


A portion of Lot 1, Tract G of FIRST ADDITION TO FULFORD, according to the plat thereof recorded in Plat Book 2 at Page 103 of the Public Records of Miami-Dade County, Florida being more particularly described as follows:


COMMENCE at the Northeast corner of the Northwest 1/4 of Section 16, Township 52 South, Range 42 East, Miami-Dade Florida; thence run S0252'42"E, along the centerline of NE 22 Avenue (Harriet Tubman Highway), for a distance of 118.97 feet; thence run S8830'28"W, for a distance of 25.00 feet, to a point on the Westerly Right-of-Way line of NE 22 Avenue, said point also being the POINT OF BEGINNING of the herein described parcel of land; thence run S0252'42"E, along the Westerly Right-of-Way line of NE 22 Avenue, for a distance of 258.44 feet; thence run S8952'07"W, for a distance of 2.80 feet; thence run S0252'42"E, for a distance of 3.30 feet; thence run S8952'07"W, for a distance of 1.71 feet; thence run N0252'42"W, for a distance of 261.63 feet; thence run N8830'28"E, for a distance of 4.50 feet to the POINT OF BEGINNING.


Containing 1,168 Square Feet or 0.027 acres more or less.


2. You and each of you are hereby commanded to file written defenses to the said Petition in the Office of the Clerk of the Circuit Court in and for Dade County, Florida, in the City of Miami, Miami-Dade County, Florida, MAY 28 2026 and to serve a copy on the undersigned attorney, on or before the May 28,2026 (being not less than twenty-eight nor more than sixty days from the date of this notice), which defenses shall show what right, title or interest you or any of you have or claim in and to the said above described parcel of land and to show cause why the fee simple interest as to said parcel should not be taken for the uses and purposes set forth in the said Petition; and to show whether you request a hearing on the Petition for order of taking, or default may be entered against you.


 3. You are further notified that a declaration of taking has been filed by the petitioner in the above styled cause, wherein the petitioner has declared that the lands and interest to said lands therein described are taken for the use of the petitioner and for the purposes set forth in the Petition; and that the Petition will be presented to the Honorable Milton Hirsch, Judge of the Circuit Court of the Eleventh Judicial Circuit of Florida, 20 Northwest 1st Avenue, Room OSJC, 23.237, Miami, Florida 33128, on June 15th, 2026 at 2:00 P.M., for an order of taking on all matters properly before the Court, including the said declaration of taking, the jurisdiction of the Court, the sufficiency of the pleadings, whether the petitioner is properly exercising its authority, and the amount to be deposited for the property interests sought to be appropriated and the Court shall make such order as it deems proper.
