NORTHWEST FLORIDA WATER MANAGEMENT DISTRICT NOTICE OF INTENT TO ADOPT PROPOSED RULES NOTICE OF INTENT: In accordance with Chapters 373 and 120, Florida Statutes, the Northwest Florida Water Management District (District) herby notices its intent to adopt proposed rule amendments to Chapter 40A-2, Florida Administrative Code, Consumptive Uses of Water, published in the Florida Administrative Register on November 26, 2025 with corrections published in the Florida Administrative Register on January 30, 2026. SUMMARY OF AMENDMENTS: The rule adoption for Chapter 40A-2, Florida Administrative Code, will cover amending and clarifying rules to comply with Subsections 373.219(3) and 373.250(9), F.S., to be consistent with DEP Rule Chapter 62-41, F.A.C., to update incorrect references, to include exemptions for any prevention or recovery strategies established pursuant to Section 373.0421, F.S., and to prohibit increases to permitted allocations in a Water Resource Caution Area or Area of Resource Concern through use of a letter modification.
