NOTICE OF INTENT TO USE UNIFORM METHOD OF COLLECTING
NON-AD VALOREM ASSESSMENTS
The Town Commission ("Town Commission") of the Town of Melbourne Beach, Florida (the "Town") hereby provides notice, pursuant to Section 197.3632(3)(a), Florida Statutes, ofits intent to use the uniform method of collecting non-ad valorem special assessments to be levied over a number of years within certain areas of the incorporated area of the Town. The potential special assessment areas could include areas created to fund the cost of providing stormwater services, capital infrastructure, roadway improvements, water and wastewater services and facilities improvements, fire station improvements and/or operational and maintenance cost of providing fire services. Each assessment area is to be located in a separate, to be established, assessment area which may be located within the incorporated area of the Town for the Fiscal Year beginning on October 1, 2026, and thereafter.
The Town will consider the adoption of a resolution electing to use the uniform method of collecting such assessments authorized by Section 197.3632, Florida Statutes, at a public hearing to be held on February 18, 2026, or as soon thereafter as the matter may be heard, at Community Center, 509 Ocean Avenue, Melbourne Beach, Florida. Such resolution will state the need for the levy and will contain a legal description of the boundaries of the real property subject to the levy. Copies of the proposed form of resolution, which contains the legal description of the real property subject to the levy, may be obtained from the Town Clerk at 321-724-5860.
All affected real property owners have a right to appear at the hearing and to file written objections with the Town Clerk any time prior to the public hearing. Pursuant to Section 286.0105, Florida Statutes, the Town hereby advises the public that if a person decides to appeal any decision made by the Town Commission with respect to this or any matter considered at a hearing, such person must ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based.
The needs of a hearing or visually impaired person shall be met if the Town of Melbourne Beach is notified at least 48 hours prior to the public hearing by any person wishing assistance.
