UNITED STATES DISTRICT COURT SOUTHERN DISTRICT OF FLORIDA “IN ADMIRALTY” Case No.: 1:26-cv-20136-WPD IN THE MATTER OF THE: Complaint and Petition of WATERFRONT CONSTRUCTION, INC., a Florida Profit Corporation, as owner of a 1991 25’ Tugboat, Hull Identification Number (HIN) FLZN6951A291, Florida Registration Number FL9726GH, and a 1977 108’ SWOB Deck Barge, HIN 1103930, including their engines, gear, tackle, appurtenances, equipment, furniture, etc., for Exoneration from and/or Limitation of Liability, Petitioner LIMITATION INJUNCTION AND MONITION THIS CAUSE coming before the Court on the Complaint and Petition for Exoneration from or Limitation of Liability filed by Petitioner in the above-referenced action pursuant to Supplemental Rule F. The Court being satisfied that the Petitioner has complied with all of the requirements of Supplemental Rule F(1) and F(2), the Court accordingly issues this Injunction enjoining the further prosecution of any action or proceeding against the Petitioner or the Petitioner’s property with respect to any claim which is the subject of this action. All persons asserting claims with respect to the subject matter of this Petition concerning any loss, damage or injury arising out of the incident described in the Complaint and Petition for Limitation of Liability of caption, involving the Petitioner’s Vessels and occurring on or about July 28, 2025, are admonished to file their respective claims with the Clerk of this Court and to serve a copy of said claims on the attorneys for the Petitioner on or before April 10, 2026, at the following address: WILSON ELSER ET. AL. LLP, c/o Gustavo A. Martinez Tristani, 100 SE 2nd Street, Suite 2100, Miami, FL 33131, and email: gustavo.martinez-tristani@wilsonelser.com. Counsel for Petitioner is directed pursuant to Rule F(4) to mail a copy of this Limitation Injunction and Monition to every person known to have made a claim against the vessel or the Petitioner arising out of the subject matter of this action.
