DEPARTMENT OF ENVIRONMENTAL PROTECTION NOTICE OF INTENT TO
APPROVE INDIVIDUAL PROJECT WITHIN ECOSYSTEM MANAGEMENT AREA
The Department of Environmental Protection gives notice of its intent to approve an individual project of The St. Joe Company, 130 Richard Jackson Boulevard, Suite 200, Panama City Beach, Florida 32407 and RaceTrac, 200 Galleria Pkwy SE Ste 900, Atlanta, GA 30339, File Number 0469015-001-EA/03, an approximate 2.66 acre site within the Ecosystem Management Area established through the binding St. Joe Amended Ecosystem Management Agreement For Bay and Walton Counties entered into by The St. Joe Company and the Department on October 11, 2004, for certain regulatory approvals for dredge and fill and stormwater activities within a 31,369 acre tract of land in Bay and Walton Counties.The individual project approval is for a project known as RaceTrac PCB Pkwy. The project site is located within an approximately 2.66 acre site located at Griffin Blvd. and PCB Pkwy. in Panama City Beach, Florida 32413. The proposed scope will include the construction of a RaceTrac gas station and stormwater management system. Stormwater quantity and quality management will be achieved through two (2) dry retention ponds. The dry retention ponds are an interconnected system that is designed to provide the required 10,711 cu-ft of combined treatment volume with recovery within 72 hours.. The Department has determined that the applicant has provided reasonable assurance that the project complies with the terms of the EMA.The application for this individual project approval, as well as the binding St. Joe Amended Ecosystem Management Agreement For Bay and Walton Counties is available for public inspection during normal business hours, 8:00 a.m. to 5:00 p.m., Monday through Friday, except legal holidays, at the Department's Northwest District office, 160 Government Street, Suite 308, Pensacola, Florida 32502. The Department's proposed agency action shall become final unless a timely petition for administrative hearing is filed under Sections 120.569 and 120.57 of the Florida Statutes before the deadline for filing a petition. The procedures for petitioning for a hearing are set forth below. Mediation is not available. A person whose substantial interests are affected by the Department's action may petition for an administrative proceeding (hearing) under Sections 120.569 and 120.57 of the Florida Statutes. Any challenge to the proposed agency action on the individual project shall be limited to whether or not the individual project complies with the terms of the EMA. The petition must contain the information set forth below and must be filed (received by the clerk) in the Office of General Counsel of the Department at 3900 Commonwealth Boulevard, Mail Station 35, Tallahassee, Florida 32399-3000. Under subsection 62-110.106(4) of the Florida Administrative Code, a person whose substantial interests are affected by the Department's proposed action may also request an extension of time to file a petition for an administrative hearing. The Department may, for good cause, grant the request for an extension of time. Requests for extension of time must be filed with the Office of General Counsel of the Department at 3900 Commonwealth Boulevard, Mail Station 35, Tallahassee, Florida 32399-3000, before the applicable deadline. A timely request for extension of time shall toll the running of the time period for filing a petition until the request is acted upon.If a timely and sufficient petition for administrative hearing is filed, other persons whose substantial interest will be affected by the outcome of the administrative process have the right to petition to intervene in the proceeding. Intervention will be permitted only at the discretion of the presiding officer upon the filing of a motion in compliance with rule 28-106.205 of the Florida Administrative Code. In accordance with subsections 28-106.111(2) and 62-110.106(3)(a), F.A.C., petitions for an administrative hearing by the applicant must be filed within 21 days of this notice. Petitions filed by any persons other than the applicant, and other than those entitled to written notice under
Section 120.60(3) of the Florida Statutes, must be filed within 21 days of publication of this notice. Under section 120.60(3) of the Florida Statutes, however, any person who has asked the Department for notice of agency action may file a petition within 21 days of receipt of such notice, regardless of the date of publication. The petitioner shall mail a copy of the petition to the applicant at the address indicated above at the time of filing. The failure of any person to file a petition for an administrative hearing within the appropriate time period shall constitute a waiver of that person's right to request an administrative determination (hearing) under sections 120.569 and 120.57 of the Florida Statutes.
