A26A1365

Appellant moved in the Court of Appeals to remand the appeal to the trial court for completion of the record.

Summary

The Georgia Court of Appeals granted the appellant's motion to remand this criminal appeal to the trial court so the trial court can complete the appellate record. The trial court is directed to add exhibits that were properly admitted at the October 4, 2022 hearing. After the exhibits are filed or the trial court issues an order that the exhibits are unavailable, the Fulton County Superior Court Clerk must transmit the full record, transcripts, and exhibits back to the Court of Appeals for re-docketing under the existing notice of appeal.

Issues Decided

  • Whether the appellate record must be completed by remanding to the trial court to include exhibits properly admitted at the October 4, 2022 hearing.
  • What steps the trial court and clerk must take once the exhibits are filed or deemed unavailable.

Court's Reasoning

The Court granted the motion because the appellate record was incomplete without exhibits that were admitted at the October 4, 2022 hearing. Completing the record is necessary for the Court of Appeals to perform its review, so the trial court must file the exhibits or issue an order that they are unavailable, after which the clerk must transmit the full record to this Court.

  3. 3

    Appellant/State monitor compliance

Counsel for both parties should monitor the trial court and clerk to ensure timely filing and transmission, and be prepared to notify the Court of Appeals if compliance issues arise.
