Appeal from the trial court’s denial of a motion for leave to file an out-of-time appeal following guilty pleas to armed robbery and a firearms offense
Summary
The Court of Appeals dismissed Vincent A. West’s appeal for lack of jurisdiction. West pleaded guilty in 2019 and sought leave to file an out-of-time appeal; the trial court denied that request on January 23, 2026. West filed a notice of appeal on February 25, 2026, which was 33 days after the trial court’s order. Because Georgia law requires a notice of appeal within 30 days, the appellate court concluded it had no jurisdiction and dismissed the appeal.
Issues Decided
- Whether the Court of Appeals has jurisdiction when a notice of appeal is filed more than 30 days after the trial court’s order
- Whether a notice of appeal filed 33 days after entry of the trial court’s order satisfies OCGA § 5-6-38(a)
Court's Reasoning
Under OCGA § 5-6-38(a), a notice of appeal must be filed within 30 days of the judgment or order to confer jurisdiction on the Court of Appeals. The court treated timely filing of the notice as an absolute jurisdictional requirement. Because West’s notice was filed 33 days after entry of the order denying leave, the court lacked jurisdiction and therefore dismissed the appeal.

What You Should Do Next
- 1
Consult a criminal appellate attorney
Talk with counsel promptly to evaluate possible collateral remedies such as a petition for habeas corpus or other post-conviction relief that might address timeliness or constitutional claims.
- 2
Consider filing collateral relief in trial court
Explore motions or petitions available in the trial court or superior court to challenge the conviction or the denial of an out-of-time appeal, subject to applicable statutes of limitation.
Frequently Asked Questions
- What did the court decide?
- The Court of Appeals dismissed West’s appeal because his notice of appeal was filed after the 30-day deadline, so the court had no jurisdiction to consider the appeal.
- Who is affected by this decision?
- Vincent A. West is directly affected because his attempt to appeal the denial of an out-of-time appeal was dismissed; the State is the opposing party.
- What happens next for West?
- Because the appeal was dismissed for lack of jurisdiction, West may need to seek other post-conviction remedies in the trial court or consult counsel about any available collateral relief.
- Why did the timing matter?
- Georgia law requires a notice of appeal within 30 days of the order or judgment; missing that deadline means the appellate court cannot hear the case.

Court of Appeals
of the State of Georgia
ATLANTA,____________________
May 04, 2026
The Court of Appeals hereby passes the following order:
A26A1776. VINCENT A. WEST v. THE STATE.
In September 2019, Vincent A. West pleaded guilty to armed robbery and
possession of a firearm during the commission of a felony. In November 2026, West
filed a motion for leave to file an out-of-time appeal. The trial court determined West
was not entitled to an out-of-time appeal and dismissed the motion on January 23,
2026. West filed a notice of appeal on February 25, 2026. We, however, lack
jurisdiction.
A notice of appeal must be filed within 30 days of entry of the judgment or trial
court order sought to be appealed. OCGA § 5-6-38(a). The proper and timely filing
of a notice of appeal is an absolute requirement to confer jurisdiction upon this Court.
Yanes v. Escobar, 362 Ga. App. 896, 898 (870 SE2d 506) (2022). Because West did not
file his notice of appeal until 33 days after entry of the trial court’s order, we lack
jurisdiction to consider his appeal, which is hereby DISMISSED.
