NOTICE TO DEBTORS AND CREDITORSWithin 60 days from the date of qualification, a personal representative is responsible for placing an advertisement for four weeks in the county newspaper requesting creditors of an estate to render an account of their demands. (1) To be entitled to an equal participation with creditors of equal dignity, creditors must bring their claims within three months of the date of the last publication. (2) If a creditor gives notice of its claim after this three-month period, it will lose all rights to an equal participation with creditors of equal dignity to whom distribution has already been made, and it will not be able to hold the personal representative liable for a misappropriation of the funds. (3) Such creditors will, however, be paid for their claims if there are sufficient assets in the estate, and there are no unpaid claims of higher dignity. (4) If a personal representative distributes an estate to the heirs without notice to an existing debt, the creditor may compel the heirs to contribute pro rata to the payment of the debt.
