RESOLUTION NO. R-1-26-3-19 A RESOLUTION AUTHORIZING THE SALE OF SURPLUS PUBLIC REAL ESTATE OF THE VILLAGE OF WYANET, ILLINOIS BY VILLAGE STAFF AS DETERMINED TO BE IN THE BEST INTERESTS OF THE VILLAGE WHEREAS, the Village of Wyanet, Illinois, holds an interest in certain real estate consisting of land commonly known as 308 S. Walnut St., Wyanet, Illinois and, more particularly described as follows: Lots 5 and 6 in Block 3 in Brown's Addition to the Village of Wyanet, Bureau County, Illinois (PIN: 15-21-176-010) Hereinafter, referred to as the "Surplus Real Estate". WHEREAS, on September 9, 2025, the corporate authorities of the Village of Wyanet passed Resolution R-4-25-9-9 authorizing its sale; WHEREAS, the value of the Surplus Real Estate has been determined to be $12,000.00 by a written MAI certified appraisal or a written certified appraisal of a State licensed real estate appraiser, which appraisal is available for public inspection at the office of the Village Attorney, Jacob J. Frost, 102 E. St. Paul St., Spring Valley, Illinois 61362 during normal business hours or otherwise available, by appointment, from the Village Clerk, 116 N. Locust St., Wyanet, IL 61329; Telephone: (815) 699-2631; WHEREAS, the Surplus Real Estate is currently located within a R-2 Residential zoning district within the County of Bureau and is vacant land; WHEREAS, no newspaper is published in the Village of Wyanet, Illinois; WHEREAS, six (6) months have passed following September 9, 2025 and no offer to purchase the Surplus Real Estate for at least 80% of appraised value has been received by the Village; WHEREAS, the population of the Village of Wyanet is less than 20,000 and the Village is situated wholly within a county that has an unemployment rate, as determined by the Illinois Department of Employment Security, higher than the national unemployment average, as determined by the U.S. Department of Labor, for at least one month during the 6 months preceding the adoption of this Resolution; and WHEREAS, in accordance with the provisions of 65 ILCS 5/11-76-4.2, the corporate authorities of the Village intend to accept any offer or bid determined by them to be in the best interest of the Village by a vote of three-fourths of the corporate authorities then holding office. NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Wyanet, County of Bureau, Illinois, as follows: SECTION 1. RECITALS. That the foregoing recitals shall be and are hereby incorporated into and made a part of this Resolution as if fully set forth in this Section 1. SECTION 2. ENACTMENT. The sale of the Surplus Real Estate shall be conducted by the President or his designee, of the Village of Wyanet following publication of this Resolution in a newspaper published in Bureau County, Illinois, at the first opportunity following its passage. Contract proposals must be received in the office of the Village Attorney, Jacob J. Frost, 102 E. St. Paul St., Spring Valley, Illinois 61362 no later than noon on May 11, 2026. SECTION 3. RESOLUTION OF CONFLICTS. All resolutions or ordinances in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4. SAVING CLAUSE. If any section, paragraph, clause, or provision of this Resolution shall be held invalid, the invalidity thereof shall not affect any of the other provisions of this Resolution, which are hereby declared to be separable. SECTION 5. EFFECTIVE DATE. This Resolution shall be in full force and effect from and after its passage and approval as provided by law.
