STATE OF NEW JERSEY TO: IAN T. SMITH
YOU ARE HEREBY summoned and required to serve upon LEOPOLD & ASSOCIATES, PLLC, Attorneys for Plaintiff, whose address is 80 BUSINESS PARK DRIVE., SUITE 110, ARMONK, NY 10504, an answer to the Complaint and Amendment to Complaint filed in a civil action in which NEWREZ LLC D/B/A SHELLPOINT MORTGAGE SERVICING is plaintiff and IAN T. SMITH; MR./MRS. SMITH, SPOUSE OF IAN T. SMITH; UNITED STATES OF AMERICA and STATE OF NEW JERSEY, are defendants in CAMDEN County, and bearing DOCKET NUMBER F-003227-26, within 35 days after 5/1/2026, exclusive of such date or if published after 5/1/2026, 35 days after the actual date of publication, exclusive of such date. If you fail to do so, judgment by default may be rendered against you for the relief demanded in the Complaint and Amendment to Complaint. You shall file your answer and proof of service in duplicate with the Clerk of the Superior Court, Hughes Justice Complex, CN-971, Trenton, New Jersey, 08625, together with your check in the sum of $175.00 representing the filing fee in accordance with the rules of Civil Practice and Procedure.
This action has been instituted for the purpose of (1) foreclosing a mortgage dated 12/31/2015, made by KELLI M HIXON , as mortgagors, to WELLS FARGO BANK, N.A., in the sum of $ 89,072.49 recorded on 3/8/2016 in Book 10353, of mortgages for CAMDEN County, page 273, and subsequently assigned to plaintiff, and (2) to recover possession of, and concerns premises commonly known as 3617 DELAWARE AVENUE, PENNSAUKEN, NJ 08109 Lot 18, Block 3810. If you are unable to obtain an attorney, you may communicate with the New Jersey Bar Association by calling 732-249-5000. You may also contact the Lawyer Referral Service of the County of venue by calling 856-482-0620. If you cannot afford an attorney, you may communicate with the Legal Services Office of the County of venue by calling 856-964-2010.
YOU, IAN T SMITH, are made a defendant because you executed plaintiff's obligation and mortgage being foreclosed herein and may be liable for any deficiency and because you are the owner of record of the mortgaged premises being foreclosed herein and for any lien, claim or interest you may have in to or against the mortgaged premises.
You will have the option to participate in New Jersey's Foreclosure Mediation Program by submitting a request to the Court. Notice of the option to participate in the Foreclosure Mediation Program must adhere to the requirements of any court rules, procedures, or guidelines adopted by the Supreme Court. Whenever a homeowner-borrower initiates mediation or is ordered to participate in the mediation program, that homeowner-borrower shall be responsible for submitting a certification document to the court, confirming that they meet the definition of a homeowner-borrower and that the property being foreclosed upon continues to be an eligible property. The certification document submitted to the court shall also be signed by the trained foreclosure prevention and default mitigation counselor, verifying that the trained foreclosure prevention and default mitigation counselor is counseling the homeowner-borrower. Additionally, you are entitled to housing counseling at no cost to you through the New Jersey Foreclosure Mediation Program. Pursuant to subsection b. of section 4 of P.L.2019, c.64 (C.2A:50-77), obtaining the assistance of a trained foreclosure prevention and default mitigation counselor is a prerequisite to participation in mediation. Pursuant to subsection c. of section 4 of P.L.2019, c.64 (C.2A:50-77), the homeowner-borrower is not required to pay any fees in order to participate in mediation.
