PLEASE TAKE NOTICE that the Applicant, 1312 3rd Avenue Hldgs-Faherty, LLC, has applied to the Spring Lake Borough Planning Board for Preliminary & Final Site Plan approval with variances to allow them to use the old bank building as a new restaurant/café with outdoor seating along with the sale of associated food items in the new restaurant/café . Variances are needed for Impervious Coverage, Parking, and Side Yard Setback. Variances will also be requested for the Sign “A” located in the rear of the building (hand painted), Lettering Height, and Maximum Fonts. Sign “D” which is on the front of building on Third Avenue, and will require a variance for Maximum Fonts (hand painted). The applicant will therefore request the following variances in violation of Section 43-12D et al. as set forth below.
 
Variance #1 – Side Yard Setback – 4.88 feet proposed, whereas 10 feet is required;
 
Variance #2 – Max. Impervious Coverage – 87.08% proposed, whereas 70% is permitted;
 
Variance #3 – Off-Street Parking - 17 stalls proposed, whereas 44 stalls are required;
 
Variance #4 – Sign A (Rear of Building)- Lettering Height – Max 18 inches permitted, 22 3/8 proposed;
 
Variance #5 – Sign A (Rear of Building) - Maximum Fonts Permitted, 2 Fonts permitted, 3 fonts proposed;
 
Variance #6 – Sign D (Front of Building – Third Avenue) – Maximum Fonts Permitted – 2 Fonts permitted, 3 fonts proposed
 
The applicant will also ask to remove the easement by prescription on Third Avenue that benefits the neighbor located at 1308 Third Avenue, Block 80 Lot 10 and will give them an easement for ingress and egress off of Washington Avenue to enter and exit the applicant's property at 1312 Third Avenue.
 
The applicant will also ask for any other variances whether bulk or use and/or waivers found during engineer review prior to hearing or as deemed necessary by the Board at time of hearing.
 
The premises affected are known as Lot 8 in Block 80 on the Spring Lake Tax Map, and is located at 1310-1312 Third Avenue, Spring Lake, New Jersey AND Lot 10 in Block 80 on the Spring Lake Tax Map, and is located at 1308 Third Avenue, Spring Lake, New Jersey.
 
The hearing shall take place on February 25, 2026, at 7:00 p.m. or as soon thereafter as it can be heard at the Municipal Building, Fifth and Warren Avenues, Spring Lake, N.J.
 
A copy of the application and plans have been filed in the Office of the Board Secretary and may be inspected by the public during regular business hours in the office of the Secretary of the Board in the Municipal Building, Fifth and Warren Avenues, Spring Lake, New Jersey.
