BOROUGH OF CHESILHURST
ORDINANCE NO.2026-2
AN ORDINANCE AMENDING THE CODE OF THE BOROUGH OF CHESILHURST TO ESTABLISH THE POSITION OF DIRECTOR OF PUBLIC WORKS AND DEFINING THE DUTIES, QUALIFICATIONS, AND MANDATORY CERTIFICATION REQUIREMENTS THEREOF.
WHEREAS, the Borough Council of the Borough of Chesilhurst finds it necessary to provide for the efficient management and supervision of the Department of Public Works; and
WHEREAS, N.J.S.A. 40A:9-154.6 sets forth certain requirements for the position of Superintendent/Director of Public Works, including certification as a Certified Public Works Manager (CPWM).
NOW, THEREFORE, BE IT ORDAINED by the Borough Council of the Borough of Chesilhurst, County of Camden, State of New Jersey, as follows:

SECTION I: Position Created
There is hereby created the position of Director of Public Works for the Borough of Chesilhurst. The Director shall serve as the department head and shall report directly to the Mayor and the Borough Council.
SECTION II: Appointment and Term
• Appointment: The Director shall be appointed by the Mayor with the advice and consent of the Borough Council.
• Term: The Director shall serve at the pleasure of the governing body, subject to any tenure or statutory protections provided under New Jersey law.
SECTION III: Qualifications and Mandatory Certification
At the time of appointment, the Director of Public Works shall meet the following criteria:
1. Experience: Minimum of five (5) years of experience in public works, construction management, or a related field in a supervisory capacity.
2. Education: A high school diploma or equivalent is required; a bachelor's degree in a related field is preferred.
3. Mandatory Certification (CPWM): In accordance with N.J.S.A. 40A:9-154.6, the Director must hold a valid Certified Public Works Manager (CPWM) certificate issued by the State of New Jersey.
4. Conditional Appointment Provision: Should the Borough appoint an individual not yet possessing a CPWM certificate, such appointment shall be conditional upon the following:
o The appointee must enroll in the New Jersey Certified Public Works Manager (CPWM) license coursework through the Rutgers Center for Government Services.
o The appointee must successfully complete all required coursework and obtain the CPWM license within three (3) years of the date of hire/appointment.
o At the discretion of the Borough, failure to obtain the CPWM license within this three-year period may result in the termination of employment or a return to a non-supervisory role.
SECTION IV: Powers and Duties
The Director of Public Works shall be responsible for:
• Planning, organizing, and directing the programs and activities of the Department of Public Works.
• Supervising the maintenance of borough roads, parks, public buildings, and infrastructure.
• Managing the departmental budget, including the procurement of heavy equipment and materials.
• Developing and implementing a comprehensive snow removal and emergency response plan.
SECTION V: Compensation
The salary for the Director of Public Works shall be established in the Borough's annual Salary Ordinance.
SECTION VI: Repealer and Severability
All ordinances or parts of ordinances inconsistent herewith are hereby repealed. If any part of this Ordinance is found invalid, the remainder shall remain in full force and effect.
SECTION VII: Effective Date
This ordinance shall take effect upon final passage and publication as provided by law.

NOTICE IS HEREBY GIVEN that the foregoing Ordinance was introduced and read by title at a meeting of the Borough Council of the Borough of Chesilhurst, County of Camden, New Jersey, held on the 5th day of February 2026 and will be considered for final passage after a public hearing thereon at a meeting of the Borough Council to be held at the Municipal Building, 201 Grant Avenue, Chesilhurst, NJ 08089 on the 5th day of March 2026, at 6:36 P.M., or as soon thereafter as the matter may be heard, at which time all persons interested may appear and be heard.
Prior to second reading, a copy of this Ordinance shall be posted in the Borough Hall and copies shall be made available at the Borough Clerk's office at the Borough Hall to members of the general public who may request such copies.
