Public Notice NOTICE OF HEARING PLEASE TAKE NOTICE: The Applicant, Hollywood Assets, LLC, the owner of the hereinafter described property, has applied to the Land Use Board of Borough of Mount Arlington to grant Minor Subdivision Approval to permit the subdivision of certain property, located at 3 Maple Path, Mount Arlington, NJ, 07856 in the RA-40 Residential Zone and also known and designated as Block 84, Lot 1 on the official tax maps of the Borough of Mount Arlington, Morris County, New Jersey. The Applicant proposes to subdivide the existing 158,120sf. (approximately 3.63 acres), subject property, into two (2) residential lots, Proposed Block 84 Lot 1 and proposed Lot 1.01, requiring certain variances as set forth below. Proposed Lot 1, upon which is located an existing two story single-family residential dwelling with a detached garage, will be 96,494sf. (approximately 2.22 acres) and Proposed Lot 1.01, which will be vacant, and upon which construction of a single-family dwelling will be proposed in the future (but not as part of this Application), will be 61,626sf. (approximately 1.42 acres). It is noted that the existing single-family dwelling has a pre-existing non-conforming front yard setback of 15.3ft where 20ft is required in the RA-40 Zone, and this pre-existing non-conformity is proposed to remain as is for Lot 1. It is also noted that the Lot 1 has a pre-existing lot width of 150ft where 175ft is required in the RA-40 zone. This pre-existing non-conforming condition is also proposed to remain as is for Lot 1. Neither of these pre-existing conditions will be exacerbated by the proposed subdivision of the property. In the event the Board determines that a variance is required for these pre-existing non-conforming conditions. The Applicant will request that such variances be granted. In conjunction with the aforesaid Application and in addition to the preexisting non-conforming conditions set forth above, the Applicant will request the Land Use Board to grant certain variance as follows: (a) Planning Variance -As one lot of the proposed subdivision does not abut a street that meets the conditions and requirements of N.J.S.A, 40:55D-35, a variance from N.J.S.A. 40:55D-35 pursuant to N.J.S.A. 40:55D-36, is requested, together with certain other deviations, exceptions and waivers from the provisions of the Zoning Ordinances of the Borough of Mount Arlington, as may be set forth in the Application. (b) Accessory Structure Located in Front Yard: According to 1732.1e of the Mount Arlington Zoning Ordinances, no accessory building or structure shall be permitted in any front yard, with front yards being considered where any frontage is on a street. The shed on existing Lot 1 is located in the front yard and has an existing non-conforming front yard setback of 43.2 feet from the Elizabeth Way right-of-way and whereas the same condition is proposed for new proposed Lot 1, a variance pursuant to N.J.S.A. 40:55D 70c is required and requested (c) Accessory Structure Minimum Side Yard Setback: According to 1732.2b of the Mount Arlington Zoning Ordinances, swimming pools may be erected in the rear yard of such lot and shall be located no closer than 15 feet from any lot line or the setbacks as specified in Schedule 1. There is an aboveground swimming pool on existing Lot 1 that is less than 15 feet from the side yard lot line, and whereas the same condition is proposed for new proposed Lot 1, a variance pursuant to N.J.S.A. 40:55D70c is required and requested. In addition to the above request for variances, deviations, exceptions and/or waivers, if the Land Use Board deems that any other variances, deviations, exceptions or waivers are necessary or appropriate, the Applicant will request that such variances, deviations or waivers be also granted. The Minor Subdivision Application with associated variances of Hollywood Assets, LLC, is now on the Agenda of the Borough of Mount Arlington Land Use Board, and a Public Hearing has been ordered for Wednesday, March 25, 2026 at 7:00 P.M. prevailing time at Borough Hall, 419 Howard Boulevard, Mount Arlington, New Jersey 07856, at which time you, if you so desire, or any interested party, as defined in N.J.S.A. 40:55D4 may appear, either in person, or by agent or attorney and present any objections which you may have to the granting of the requested approval of the Application. All documents relating to this Application may be inspected by the Public at the Land Use Board Office, located at the Borough Hall, 419 Howard Boulevard, Mount Arlington, New Jersey 07856, Monday through Friday, between the hours of 8:30 A.M. and 4:30 P.M.
