PUBLIC NOTICETOWN OF WESTFIELD WESTFIELD, NEW JERSEYGENERAL ORDINANCE NO. 2026-04AN ORDINANCE ADOPTING AN AMENDMENT TO THE PROSPECT & FERRIS REDEVELOPMENT PLANWHEREAS, the Local Redevelopment and Housing Law, N.J.A.C. 40A:12A-1, et seq., as amended and supplemented (the “Redevelopment Law”), provides a process for municipalities to participate in the redevelopment and improvement of areas designated by the municipality as being in need of redevelopment; andWHEREAS, on October 13, 2020, the Westfield Town Council (the “Governing Body”) adopted Resolution 225-2020, declaring that the entirety of the Town of Westfield (the “Town”) met the statutory criteria for designation as an area in need of rehabilitation pursuant to the Local Redevelopment and Housing Law, N.J.S.A. 40A: 12A-1 et seq. (the “Redevelopment Law”), and designating all parcels within the Town as areas in need of rehabilitation (the “Rehabilitation Area”); andWHEREAS, the Governing Body determined that the use of the redevelopment powers granted to municipalities under the Redevelopment Law would be the most effective approach to revitalize the parcels contained in the Rehabilitation Area; andWHEREAS, included within the Redevelopment Area are the properties at 201 Prospect Street (Block 2504, Lots 12 and 13), 112 Ferris Place (Block 2504 Lot 14), and 118 Ferris Place (Block 2504, Lot 15) as shown on the official tax maps of the Town (the “Property”); andWHEREAS, the Town retained the professional planning services of Topology which has prepared a redevelopment plan for the Property dated November 17, 2021, entitled the “Prospect + Ferris Redevelopment Plan,” a copy of which is attached to this Ordinance as Exhibit A (the “Redevelopment Plan”); and WHEREAS, the Redevelopment Plan is part of an effort by the Town to promote the rehabilitation of underutilized and vacant properties in and around the Town’s core and, to advance this objective, this Redevelopment Plan sets forth a vision and standards for the adaptive reuse of the Property; andWHEREAS, on December 7, 2021, following a review of consistency by the Town’s Planning Board (“Planning Board”), the Governing Body adopted General Ordinance No. 2231, approving and adopting the Redevelopment Plan for the Redevelopment Area.WHEREAS, on May 24, 2022, the Town of Westfield entered into a Redevelopment Agreement with Ferris Prospect Development LLC, subsequently assigned to Vango Westfield LLC, as the “Redeveloper” of the Redevelopment Area (“Redeveloper”); andWHEREAS, the Redeveloper has requested that the Town amend the Redevelopment Plan to permit 118 Ferris Place (Block 2504, Lot 15) to be used temporarily for construction related activities to reduce the construction related impacts on the immediate neighborhood by removing the need for an on-site construction trailer, reduce the extent of construction related loading activity in public rights-of-way, reduce the extent of the use of on-street parking related to construction related activities, and reduce the number of necessary relocations of the Historic Structure on the Redevelopment Area during construction; andWHEREAS, on February 24, 2026, on behalf of the Town of Westfield, Mr. Donald Sammet, the Town Planner for Town of Westfield, prepared an amendment to the Redevelopment Plan (the “Amended Redevelopment Plan”), a copy of which is attached to this Ordinance as Exhibit A; andWHEREAS, immediately following the introduction of this Ordinance, the Town Clerk is hereby directed to refer this Ordinance and the Amended Redevelopment Plan to the Planning Board for its review and recommendations pursuant to the Redevelopment Law, which review shall take place within forty-five (45) days of the referral.WHEREAS, prior to final adoption of this Ordinance, the Planning Board shall have reviewed the Redevelopment Plan and issued its recommendations to the Mayor and Council and the Mayor and Council has considered such recommendations. WHEREAS, with the consent of the Redeveloper, the Town of Westfield wishes to adopt the Amended Redevelopment Plan; andNOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Town of Westfield as follows:1. That the amendment to the Redevelopment Plan prepared by Town Planner, dated February 24, 2026, a copy of which is attached to this Ordinance as Exhibit A, is hereby adopted.2. If any provision or portion of this Ordinance is held to be unconstitutional, preempted by Federal or State law, or otherwise invalid by any court of competent jurisdiction, the remaining provisions of the ordinance shall not be invalidated and shall remain in full force and effect.3. This ordinance shall take effect immediately upon final publication as required by law.4. All ordinances and parts of ordinances that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.NOTICENotice is hereby given that the foregoing ordinance was approved for final adoption by the Town Council of the Town of Westfield at a Regular Meeting held on March 10, 2026.
