NOTICE OF DECISION
Pursuant to N.J.S.A. 40:55D-10(i)
PLEASE TAKE NOTICE that the Planning Board of the Borough of Deal ("Board") did, on the 28th day of April, 2026, formally adopt a Resolution memorializing the action of the Board taken at its March 24, 2026 meeting granting ICC Neptune Ave, LLC approvals with regard to property known Lot 1 in Block 83 as shown on the Official Tax Map of the Borough of Deal and located at 8 Neptune Avenue, Deal, New Jersey ("Property").
The approval permits the construction of an in-ground swimming pool, pool cabana, pool patio, pool equipment, fencing, walls, walkways, landscaping, and related site improvements. In conjunction with the approval, the Applicant was granted bulk variance relief pursuant to NJSA 40:55D-70c as follows:
Pool cabana located in a front yard, whereas accessory structures are only permitted in a side/rear yard.
Pool cabana height of 20 feet proposed, whereas a maximum height of 18 feet is permitted.
Pool perimeter exposure above ground of 63%, whereas a maximum of 30% is permitted.
Fence/wall combination heights of 6 feet and 5.55 feet in a front yard, whereas a maximum height of 3 feet is permitted.
PLEASE TAKE FURTHER NOTICE that the Resolution and materials relied on by the Board at the meetings of April 10, 2024, March 24, 2026, and April 28, 2026, are on file at the office of the Board located at Borough Hall, 190 Norwood Avenue, Durant Square, Deal, New Jersey.
