PUBLIC NOTICE OF HEARING CITY OF ENGLEWOOD ZONING BOARD OF ADJUSTMENT PLEASE TAKE NOTICE that the undersigned has filed an appeal or application for development with the Zoning Board of Adjustment ("Zoning Board" or "Board") of the City of Englewood seeking the granting of the following variances and/or waivers hereinafter described, so as to permit the following: An application for Minor Site Plan and Conditional Use Permit Approvals ("Application") to consolidate the properties formally known as Block 2408, Lots 12.01, 28, and 29 on the Englewood Tax Map (collectively "the Properties") for use as an outdoor vehicle display lot that is accessory to the existing car dealership that has operated as a conditional use on Block 2408, Lot 12.01. The Application includes approvals for the demolition of existing masonry buildings on Block 2408, Lots 28 and 29, and grading of Block 2408, Lots 9.01 and 11.01 to match the grade of the proposed accessory parking area on the proposed consolidated lot. The subject Properties are commonly described as 74 Grand Avenue, 82 Grand Avenue, 90 Grand Avenue, 81 S. Dean Street and 77 S. Dean Street, and designated as Block 2408, Lots 9.01, 11.01, 12.01, 28 and 29 on the City of Englewood's Tax Map, respectively. This notice is sent to you as the owner of property in the immediate vicinity. The Applicant is seeking the issuance of the following variances and/or waivers: (1) a D(3) conditional use variance: The D-2e Zone requires that the outdoor display and storage of vehicles at an automobile sales establishment occupy not more than 30% of the land area of the property whereas 37% is proposed; (2) a D(3) conditional use variance: The SBD Zone requires that any motor vehicles and equipment at an automobile sales establishment shall be kept at least 15 feet from the right-of-way and property lines whereas five feet or less is proposed; and (3) the following bulk variances: (a) the D-2e Zone requires a minimum front yard setback of five feet whereas a setback of zero feet along South Dean Street is proposed; (b) the D-2e Zone requires a side yard setback of six feet whereas there is an existing nonconformity of zero feet; (c) the SBD Zone has a minimum front setback of 5 feet, where the existing nonconformity of 4.50 feet is proposed; (d) the SBD Zone requires a minimum lot width of 100 feet whereas the Properties have the following existing lot width nonconformities: Lot 9.01 is 70.67 feet, Lot 11.01 is 66.44 feet, and Lot 12.01 is 98.13 feet; (e) parking is prohibited within a required front yard whereas parking is proposed in the front yard along South Dean Street; (f) a planting island or peninsula is required following ten parking spaces in a row at an off-street surface parking facility whereas no such planting islands or peninsulas are proposed; (g) screening from the street and adjacent properties is required for an off-street surface parking facility whereas no such screening is proposed; and (h) a parking lot proposing 50 or fewer off-street parking spaces requires a minimum of one Americans with Disabilities Act-accessible parking space with electric vehicle supply equipment installed whereas no such spaces are proposed. The applicant shall also apply for such variance relief, exceptions, waivers, departures, permits, or other approvals or licenses that are deemed necessary or appropriate by the Applicant or the Board and which may arise during the course of the hearing process. The Applicant may also revise the plans pursuant to comments made upon a review of the plans, testimony, and other materials at the public hearing without further notice.
