RESOLUTION TOWN OF HACKETTSTOWN LAND USE BOARD EXTENSION OF APPROVAL FOR AMENDED PRELIMINARY AND FINAL SITE PLAN CZIG MEISTER BREWING COMPANY, LLC APPLICATION #22-04 RESOLUTION # R23-13 (04/25/23; 12/11/23) WHEREAS, Czig Meister Brewing Company, LLC, is an entity that owns two adjacent lots, 3 & 10, with an address of 106 Valentin Street, Hackettstown, NJ 07840, and received approval for an application for Preliminary and Final Site Plan approvals (the “Approval”) for property known as Lots 3 & 10, Block 73 (hereinafter the "Property"); and WHEREAS, the Applicant's Approval included an approval to access the Property across adjacent Lot 1; and WHEREAS, the subject property is located in the Town of Hackettstown's CC (Community Commercial) zoning district; and WHEREAS, the Applicant has requested an extension of the deadline for Preliminary and Final Site Plan Approval; and WHEREAS, the Applicant was represented by Michael Selvaggi, Esq., of Lavery, Selvaggi & Cohen, PC, Hackettstown, NJ; and WHEREAS, the Town of Hackettstown Land Use Board (the “Board”) considered the original amended application at a properly noticed regular public meeting of the Town of Hackettstown Land Use Board, on February 28, 2023; and WHEREAS, the Applicant was before the in February 2023 when they were approved in a Resolution memorialized on April 25, 2023 for “D-4” use variance relief from the Land Use Board to develop the Property with an expanded footprint for its brewery that will extend the non-conforming floor area ratio (“FAR”) from 44 percent to 60 percent, where a maximum of 25 percent is allowed per LDO section 407D; and WHEREAS, in April 2023, the Applicant received approval for a D-4 variance to increase the floor area of the building on Lot 3 due to the building addition, as well as a D-1 variance for both Lot 3 and Lot 10 to allow outdoor seating areas (Lot 3) and outdoor parking and storage (Lot 10); and WHEREAS, the Applicant was before the Board previously in 2019 when they were approved for a third outdoor seating area, reduced the number of parking stalls on Lot 3, and allowed the use of 20 parking stalls as well as a trash enclosure on Lot 10 to serve the microbrewery use on Lot 3; and WHEREAS, the Applicant was also before the Board previously in 2018 when they were approved for two outdoor seating areas and other parking and accessory updates; and WHEREAS, most recently on December 11, 2023, the Applicant received approval of a Resolution to amend the site plan approvals granted on February 28, 2023 and memorialized by Resolution R22-09 on April 25, 2023 to allow for a two-story addition on Lot 3 that has an open air deck on the second floor, rather than the previously approved enclosed space on the second floor; and WHEREAS, the most recent approval was memorialized on December 11, 2023 as R23-13, and WHEREAS, the Town of Hackettstown considered the application for the extension at a properly noticed regular public meeting of the Town of Hackettstown Land Use Board held on March 24, 2026; and WHEREAS, the Applicant now seeks two consecutive retroactive one-year extensions pursuant to NJSA 40:55D-52(d) of the period of protection from ordinance changes for the Preliminary and Final Site Plan, Use Variance, and Bulk Variance Approval in accordance with the subject Property; and WHEREAS, the Board does hereby make the following findings of fact and conclusions of law based upon the testimony and documentary evidence produced by the Applicant and / or Board and / or Town staff: 1. Applicant will continue to comply with all applicable conditions of Board Engineer Sterbenz' Technical Comment Review Letter of June 23, 2022. 2. Applicant will continue to comply with all applicable conditions of Board Planner Bloch's Report of May 24, 2022. 3. Applicant will continue to comply with all other applicable conditions of Resolution of Approval of September 28, 2022. 4. Applicant will continue to comply with all other applicable conditions of Resolution of Approval of April 25, 2023. 5. Applicant will continue to comply with all other applicable conditions of Resolution of Approval of December 11, 2023. 6. No alternations to the original Application are being requested and / or made. 7. All other necessary and applicable laws, statutes, ordinances and regulations remain in effect so as to allow the subject approval to move forward; and WHEREAS, the Applicant has demonstrated that the subject request is justified under the Municipal Land Use Law; and WHEREAS, the Applicant has demonstrated that it has been prevented from proceeding with the development because of delays in obtaining necessary approvals from the New Jersey Division of Alcohol Beverage Control (ABC), despite conscientious efforts on the part of the Applicant to do so to be able to commence construction as approved by the Board, in full of their Resolutions of Approval of April 25, 2023 as amended December 11, 2023; and WHEREAS, it is agreed that if the Site Plan is revised in a material way, and / or if any new variances are required, the Applicant will reapply to the Board for necessary approvals; and WHEREAS, after carefully considering the request, the Board has determined that an extension is warranted; and NOW, THEREFORE, BE IT RESOLVED by the Land Use Board of the Town of Hackettstown on this 24th day of March, 2026 that the request of the Applicant of the property located at 106 Valentin Street, Hackettstown, NJ 07840 known as Lots 3 & 10 in Block 73, to extend the deadline for approval for a Preliminary and Final Site Plan, Use Variance, Bulk Variance and Use Variance Approval for the Property as approved on April 25 2023 and as amended December 11, 2023 is hereby approved retroactively for two consecutive one year periods, respectively until April 25, 2026, subject to compliance and satisfaction of all conditions set forth in the underlying Approval as memorialized in the Resolution signed April 25, 2023 and as amended December 11, 2023; said Resolution(s) are attached hereto and are incorporated herein by reference.
