Legal Notices Notice is hereby given that the Town of Evans Town Clerk’s Office will accept sealed bids for: Evans Shoreline Water Main Replacement The Owner is the Town of Evans, and the work site is located in the Town of Evans. The projects limits extend along Lake Shore Road (CR111) from a point approximately 250 feet east of Point Breeze Drive near the A J Schmidt Elementary School to a point just west of the Delaware Creek bridge located near the intersection of Lake Shore Road and Lake Street. The work includes providing all labor, materials, machinery, tools, equipment and other means of construction necessary and incidental to the completion of the work shown on the plans and described in these specifications including but not necessarily limited to the following: installation of a new 10” diameter PVC water main, new valves and hydrants, reconnection of private water services, side street water service connections, and surface restorations. The proposed work will be performed while traffic is maintained along Lake Shore Drive. This is a locally funded project that utilizes Erie County Water Authority details and standards. NYSDOT Standard Specifications, officially finalized and adopted on January 1, 2026 as posted on the New York State Department of Transportation’s website must be followed by the successful bidder. There are no MBE, WBE, SDVOB, DBE, EEO goals for this project. Information and Bid Documents for the Project can be found at the following designated website: www.avalonplanroom.com in Buffalo, NY in the Public Bid Section. Bid Documents may be downloaded from the designated website for a non-refundable fee. Prospective Bidders are urged to register with the designated website as a plan holder, even if Bid Documents are obtained from a plan room or source other than the designated website in either electronic or paper format. All official notifications, addenda, and other Bid Documents will be offered only through the designated website. Neither the Owner nor Engineer will be responsible for information within Bid Documents, including addenda, if any, obtained from sources other than the designated website. If you do not have Internet access or have questions on the website, please contact Avalon Document Services at (716) 995-7777. Paper copies of the plans and specifications can be picked up at Avalon at 70 La Riviere Dr., Buffalo, NY 14202, upon a non-refundable payment made to Avalon. Payment can be made by credit card or by a check made payable to Avalon Document Services. Contract Documents, including Invitation to Bidders, Instructions to Bidders, Wage Rates, Bid Documents, Agreement, Special Notes, Specifications, Contract Drawings, and any Addenda, may be examined, at no expense, at the office of: Town of Evans or: C&S Engineers, Inc. 8787 Erie Road 141 Elm Street, Suite 100 Angola, New York 14006 Buffalo, New York 14203 between the hours of 9:00 am and 4:00 pm Monday through Friday. NOTE: Town of Evans shall not be held responsible for the completeness or accuracy of any bid documents received by a Contractor that were not directly issued to that Contractor by C&S Engineers, Inc. Any Contractor submitting a bid based on incomplete or inaccurate information resulting from documentation received from any third party, shall not have cause for relief from award or completion of a contract in accordance with the official documents on file with the Engineer. A Pre-Bid Meeting will not be held. No questions or inquiries regarding this bid will be accepted less than five (5) business days prior to the bid opening. Contractors that obtain Contract Documents from a source other than the issuing office must notify the issuing office in order to be placed on the official Plan Holder List, to receive Addenda and any other Bid correspondence. Bids received from Contractors other than those on the official Plan Holders List will not be accepted. Bidders must acknowledge receipt of all Addenda by signing and dating the Acknowledgement of Receipt of Addenda. Failure of any Bidder to receive any such Addendum or interpretation shall not relieve such Bidder from any obligation under this Bid submittal. All Addenda so issued shall become part of the Contract Documents. Questions regarding the Contract Documents should be directed to Daniel Borcz, P.E., C&S Engineers, Inc. by telephone at (716) 955-3028. Bidders shall promptly notify Daniel Borcz, P.E. of any errors, omissions, conflicts or ambiguity within the Contract Documents within five (5) business days of bid opening. All bids must include the completed Bid Form, Non-Collusive Bidding and Disbarment Certifications, and Lobbying Certifications. This is a unit price bid as described in the Instructions to Bidders. No bidder may withdraw his/her bid within forty-five (45) calendar days after the actual date of the opening thereof. Each bid must be accompanied by security in an amount not less than five percent (5%) of the amount of the bid in the form and subject to the conditions provided in the Instructions to Bidders. Bids to be considered must be received in a sealed envelope at Town of Evans Town Clerk’s Office, 8787 Erie Road, Angola, NY 14006 by 2:00 PM local time , on May 12, 2026, to be publicly opened and read aloud at the Town of Evans Town Clerk’s Office . Bids received after the above noted time will not be accepted. All sealed envelopes should be clearly labeled “ BID: EVANS SHORELINE WATER MAIN REPLACEMENT, TOWN OF EVANS, NEW YORK ”. Bids shall be submitted in ONE (1) packet, in triplicate (1 original and 2 copies). The Bidder to whom the Contract is awarded will be required to furnish Performance, Payment and Guarantee Bonds from an acceptable Surety Company for an amount not less than 100% of the accepted bid. The successful Bidder and all subcontractors must have an approved CCA-2 on file with NYSDOT prior to being awarded a contract. If the successful Bidder does not currently have a CCA-2 on file with NYSDOT, the Bidder may find the CCA-2 forms and instruction for completion online at https://osc.state.ny.us/venrep/form_cca2.htm . The successful Bidder will be required to comply with all provisions of the Federal Government Equal Employment Opportunity clauses issued by the Secretary of Labor on May 2, 1968 and published in the Federal Register (41 CFR Part 60-1, 33 F.2 7804). Successful bidders will be required to pay prevailing wage rates on this contract. The Town of Evans reserves the right to consider the bids for forty-five (45) days after receipt before awarding any Contract, and to waive any minor informalities in, and to reject, any and all bids. All bids are subject to final review and approval by the Town Board of the Town of Evans before any award of contract may be made. Receipt of bids by the Town of Evans shall not be construed as authority to bind the Town of Evans. The work shall be completed within 150 calendar days from the date of the Notice to Proceed.
