EC2024-37616 RECEIVED NYSCEF: 02/18/2026 STATE OF NEW YORK SUPREME COURT COUNTY OF WASHINGTON ELIZABETH SHARROW, Plaintiff, -against- H. LESTER RAYMOND, if said above named defendant be living, and if said defendant be dead, then any and all other persons who may claim as heirs-at-law, next-of-kin, devisees, distributees, legal representatives, and successors in interest of either or both of the named defendants, creditors, mortgagees, lienors, assigns and legal representatives of either or both of them, and successors in interest of said heirs at law, next-of-kin, devisees, distributees, and legal representatives, creditors, mortgagees, lienors, assigns and legal representatives of them and if any specifically named defendant or any defendants named as a class be dead then their heirs at law, next-of-kin, devisees, grantees, distributees, executors, trustees, administrators, assigns, mortgagees, lienors and successors in interest, and generally all parties having or claiming to have an interest in or lien upon the premises described in the complaint by, through or under any of said specifically named defendants herein or by, through or under any of the other defendants herein named specifically or as a class, all of whom and whose place of residence are unknown to the plaintiff and cannot after diligent inquiry by ascertained, Defendants. JUDGMENT Index No.: EC2024-37616 Date Filed: The Plaintiff, having commenced this action under Article 15 of the Real Property Actions and Proceedings Law to compel the determination of any claim adverse to those of the Plaintiff in and to certain real property located in the Town of Fort Ann, County of Washington, New York, and the Court having carefully reviewed a Summons and Complaint in the action, and the Court having previously signed an Order for Service dated August 20, 2025, directing service by publication upon the defendants and upon service by email to the possible heirs of defendants in the manner directed by the Court therein, NOW, upon the Plaintiff's Notice of Motion for Judgment, dated January 26, 2026 and the Affidavit of Stefanie Dilallo Bitter, Esq., sworn to January 26, 2026, in support of the motion, and it appearing to the satisfaction of the Court that service on each of the defendants was properly made by publication and email in accordance with the terms of this Court's Order for Service by Publication and that more than thirty days has elapsed since service by Publication has been completed, and that none of the defendants so served have appeared or answered, and that the time to do so has expired and has not been extended by Stipulation, Agreement, by Order of the Court, or otherwise, and upon a careful review of the facts and circumstances of the case, and due deliberation having been had thereon, and no opposition having been filed or otherwise received despite proof of service of the motion, it is hereby ORDERED, ADJUDGED, AND DECREED, that the plaintiff at the time of the commencement of this action had, and now has, a valid, absolute, and unencumbered title in fee to the following described lands and premises, to wit: a vacant parcel on Charles Street, located in the Village of Fort Ann, County of Washington, State of New York, and identified as Tax Map Parcel 112.10-2-17.1. This parcel is partially described in a deed to H. Lester Raymond, dated December 27, 1905 and recorded in Washington County Clerk's Office in Liber 139 Page 168.; and it is further ORDERED, ADJUDGED, AND DECREED, that any and all claims which any of the defendants has, or might claim to have, to the aforesaid premises and to any rights with respect thereto is without validity and of no force and effect; and it is further ORDERED, ADJUDGED, AND DECREED, that the defendants and every person claiming under them or any of them by title accruing after the filing of the Judgment Roll or of the Notice of Pendency of Action, as prescribed by law, be and they hereby are, forever barred for asserting any such claim, the invalidity of which is established in this action, to an estate or interest in the real property described above, of any kind or nature whatsoever.
