Legal Notice as per Town of Lee Local Law No. 1 of 2012 "Brush, Grass, Weeds Law of the Town of Lee, NY" Notice is hereby given that the owners, or any agent, servant, representative or employee of such owner; of any lot or land or any part thereof, weather occupied or not, in the Town of Lee to permit or maintain on any such lot or land, or along the sidewalk, street or alley adjacent to the same between the property line and the curb or middle of the street or alley 10 feet outside the property line if there is no such curb, any growth in excess ten (10) inches (254mm) on the average or any accumulation of dead brush, weeds or plant growth between April 1 through October 31. The code enforcement officer shall serve written notice upon the owner, of such lot or land to comply with the provisions of this local law. Such service shall be made be by either personal service or by mail addressed to the last known owner at such owner's address as shown on the tax rolls of the Town. If the person upon whom the notice is served fails, neglects or refuses to cut and remove or to cause to be cut and removed such brush, weeds, grass or other vegetation within ten (10) days after the service of such notice; or if no person can be found in the Town of Lee who either is or claims to be the owner of such lot or land who either represents or claims to represents such owner, the enforcement officer shall cause such weeds, brush, grass and other vegetation on such lot or land to be cut and removed, and the actual cost of such cutting and removal, plus 25% for inspection and other administrative costs in connection therewith, shall be certified by the enforcement office to the Assessor and shall thereupon become a lien upon the property in which brush, weeds, and other grass and vegetation were located and shall be added to the and become and form part of the taxes next to be assessed and levied upon such lot or land and shall bear interest at the same rate as Town and County taxes, and shall be collected and enforced in the same manner as Town taxes. Offense under this local law shall constitute a violation punishable by a fine of not less than $100 nor more than $250 or fifteen (15) days imprisonment, or both, for the first offense and not less than $250 nor more than $500 or thirty (30) days imprisonment for the second offense.
