Legal Notice # 21931322 NOTICE OF ADOPTION OF RESOLUTION NOTICE IS HEREBY GIVEN that the Town Board of the Town of Babylon, County of Suffolk, State of New York, at a regular meeting thereof held on the 25th day of March, 2026, duly adopted a resolution, an abstract of which is as follows: RESOLUTION NO. 252 MARCH 25 2026 ADOPTING LOCAL LAW 8 OF 2026 AMENDING THE CODE OF THE TOWN OF BABYLON CHAPTER 86 (BOATS) WHEREAS, the Town Board of the Town of Babylon duly called and held a Public Hearing at Babylon Town Hall, 200 East Sunrise Highway, Lindenhurst NY 11757 on the 11th day of March, 2025 upon the question of the enactment of Local Law No. 8 of 2026 of the Town of Babylon, Suffolk County, New York, being such a local law; and WHEREAS, in accordance with Part 617.6 and 617.7(b), State Environmental Quality Review (SEQR), the adoption of this local law is a Type II Action and not subject to environmental review under SEQR; and NOW, THEREFORE, be it RESOLVED AND ORDAINED, by the Town Board of the Town of Babylon, that Local Law 8 of 2026 of the Town of Babylon, Suffolk County, New York, is hereby enacted as follows and is effective upon its filing with the New York State Department of State: LOCAL LAW 8 OF 2026 AMENDING THE CODE OF THE TOWN OF BABYLON AMEND as follows: CHAPTER 86 BOATS 86-7. Removal of dangerous, unseaworthy and disabled vessels. A. Any vessel which is abandoned, is a menace to navigation or is unseaworthy or has sunk, is grounded or has otherwise become disabled shall be removed by the owner or person in charge thereof on order of the Harbor Master to such a place as shall be directed by the Harbor Master. If said vessel is not removed within 10 days after order to the owner or last user person in charge thereof to remove it, it may be removed by or at the direction of the Harbor Master or any duly authorized officer or agent thereof at the expense of the owner or person in charge of said vessel, and the expense thereof shall be a lien upon the vessel. Notwithstanding the foregoing, in the event the presence of such a vessel presents an immediate threat to life, limb or property or the owner or last user person in charge thereof is not known, the Harbor Master, in his sole discretion, without prior notice to the owner the last user person in charge thereof, may remove such vessel to such place as he/she deems necessary. The expense thereof shall be a lien upon the vessel. B. Any person or entity violating this section by failing to remove a dangerous, unseaworthy or disabled vessel as directed by the Harbor Master shall be guilty of an offense which, upon conviction, is punishable by a fine of not less than $500 and not more than $2,500 or by imprisonment for a period not to exceed six months, or both. Any person or entity found by the Bureau of Administrative Adjudication to have violated this section shall likewise be subject to a monetary penalty of not less than $500 nor more than $2,500.
