Fire District plans to sell a fire truck subject to a permissive referendum.

NOTICE OF PERMISSIVE REFERENDUM




NOTICE IS HEREBY GIVEN that the Board of Fire Commissioners of the Orchard Park Fire District in the Town of Orchard Park , Erie County, New York, at a meeting on the 10 th day of February, 2026 duly adopted the following Resolution, subject to a permissive referendum.

RESOLUTION #1




A RESOLUTION AUTHORIZING THE BOARD OF FIRE COMMISSIONERS OF THE ORCHARD PARK FIRE DISTRICT, TOWN OF ORCHARD PARK, ERIE COUNTY, NEW HORK, TO SELL OR OTHERWISE DISPOSE OF PERSONAL PROPERTY OF THE FIRE DISTICCT CONSISTING OF A 2003 AMERICAN LAFRANCE FIRE TRUCK/LT – 100-FOOT AERIAL PLATFORM WHICH VEHICLE IS NO LONGER NECESSARY FOR ANY OF THE USES OR PURPOSES OF THE DISTRICT AT SUCH TIME, AND UPON SUCH TERMS AND CONDITIONS AS THE BOARD IN ITS DISCRETION MAY DETERMINE; SAID MONIES REALIZED THEREFROM TO BE PLACED IN THE APPARATUS RESERVE FUND.

BE IT RESOLVED, by the Board of Fire commissioners of the Orchard Park Fire District in the Town of Orchard Park, Erie County, New York, as follows:




Section 1. The Board of Fire Commissioners is of the opinion that the 2003 American LaFrance fire truck is no longer needed for any uses or purposes of the district, and the Fire District is to sell or otherwise dispose of the vehicle.




Section 2. That it is determined that the monies to be received from the sale of the vehicle will not exceed $100,000.00. The District has received an offer for the truck from Sanborn Fire Company at a price of $60,000.00.




Section 3. Any monies or sums to be realized from the sale of the vehicle shall be paid into the Apparatus Reserve Fund, thereby reducing the amount of monies necessary to be borrowed by the issuance of serial bonds, which bonds are to be voted upon the electors of the Orchard Park Fire District at a mandatory referendum if one is needed for any other apparatus.




Section 4. Pursuant to Section 6-g Subdivision 5 of the General Municipal Law, any monies received shall be placed inn such Apparatus Reserve Fund.




Section 5. This resolution is adopted by subject to a permissive referendum.




Section 6. This resolution shall not take effect until 30 days after the adoption of the resolution.
