ERIE COUNTY PUBLIC NOTICE Please take notice that the following change was made in the Zoning Ordinance of the Town of West Seneca, County of Erie, and State of New York, and notice thereof is hereby given, pursuant to §264 and 265 of the Town Law. Whereas, the Town Board of the Town of West Seneca received a request to rezone property located at 120 South Avenue changing its classification from C-1 and R-50 to C-2 to allow construction of two (2) warehouse buildings for the following described property as: BEGINNING at the northwest corner of lot number sixty-eight (68); thence easterly along. the north line of lot number sixty-eight (68) (which is also the south line of Indian church Road, formerly Mineral Spring Road) sixty (60) feet; thence southerly parallel with the west line of lots Numbers Sixty-eight (68) and ninety-one (91) about one thousand fifty-two and fifty-three hundredths (1,052.53) feet to the north line of South Avenue (which is also the south line of lot number ninety-one (91); thence westerly along the north line of South Avenue sixty and five hundredths (60.05) feet to the west line of lot number ninety-one (91); thence northerly along the west line of lots numbers ninety-one (91) and sixty-eight (68) about one. thousand fifty and forty-two hundredths (1,050.42) feet to the place of beginning. EXCEPTING from the above described premises all that tract or parcel of land situate in the Town of West Seneca, County of Erie and State of New York, being part of lot sixty-eight (68) of "Middle Ebenezer“, as shown on map filed in the Erie County Clerk's Office under cover number 102, more particularly bounded and described as follows: BEGINNING at the northwest corner of lot number sixty-eight (68); thence easterly along the north line of lot number sixty-eight (68) (which is also the south line of Indian Church Road, formerly Mineral Spring Road) sixty (60) feet; thence southerly parallel with the west line of lot number sixty-eight (68) four hundred (4.00) feet; thence westerly parallel with the north line of lot number sixty-eight (68) about sixty (60) feet to the west line of lot number sixty-eight (68); thence northerly along the west line of lot number sixty-eight (68) four hundred (400) feet to the place of beginning. Whereas, this Town Board held a public hearing on the 26th day of January, 2026 at 6:00 P.M. EDT, to consider granting a rezoning for the above-described property; and Whereas, at such time and place this Town Board did meet to hear any and all persons interested in the subject thereof concerning the same. Now, therefore, be it resolved, that a rezoning is granted property located at 120 South Avenue changing its classification from C-1 and R-50 to C-2 with the following conditions: 1) no materials to be stored outside; 2) the property currently known as 134 South Avenue add a deed restriction for no future development; and 3) the two parcels be merged. Be it further resolved that the Town Clerk is hereby ordered and directed to make such change on the zoning map and to enter a copy of this resolution with the zoning regulations in a book appropriate for its use.
