Legal Notices TOWN OF ELLERY NOTICE OF PUBLIC HEARING PLEASE TAKE NOTICE that the Town of Ellery will hold a Public Hearing at the Town of Ellery Administration Building, 25 Sunnyside Avenue, Bemus Point, New York 14712 on the 10th day of March, 2026, at 6:45 pm for the purpose for the Town Board to consider a purchase offer by James and Kimberly Barnett to purchase a portion of the Town right-of-way for Chautauqua Avenue, adjacent to the real property owned by James and Kimberly Barnett at 5608 Summit Avenue, Maple Springs, New York 14712. 5608 Summit Avenue, Maple Springs, New York is known on the official County of Chautauqua tax map as SBL No. 298.14-4-14.1. The Barnetts wish to purchase a section of the Town of Ellery's right-of-way for Chautauqua Avenue approximately 30 feet in width by 173 feet in length, for the purchase price of $700.00. PLEASE TAKE FURTHER NOTICE, that at the aforementioned Public Hearing, prior to considering the above purchase offer, the Town Board shall consider whether or not the property requested to be purchased has any public use or benefit. If the Town Board makes the determination that indeed it does have a public use or benefit, it will not consider this purchase offer.
