Public Hearing Notice PUBLIC HEARING -VILLAGE OF SOUTH DAYTON, NY WEDNESDAY, MARCH 25, 20267 :00 PM PROPOSED DISSOLUTION PLAN -VILLAGE OF SOUTH DAYTON, NY The Village of South Dayton Village Board will hold a Public Hearing on Wednesday, March 25, 2026 at 7:00 pm, at the South Dayton Fire Hall, 34 Maple Street, South Dayton, NY. A Proposed Dissolution Plan for the Village of South Dayton was endorsed by the Village Board on February 11, 2026. The Public Hearing will focus on the Plan, and what government services, local laws and employee positions would be continued or stopped if the Village of South Dayton was dissolved. The Proposed Dissolution Plan for the Village of South Dayton is available for review on the Village website www.southdayton.org, the project website www.cgr.org/southdaytonstudy/ , and printed copies can be reviewed at the South Dayton Village Hall, 17 Park Street, South Dayton, NY, during Village Office hours (Monday, Wednesday, Friday from 10:00 am - 2:00 pm). The following is a summary of the Proposed Dissolution Plan: • All Village of South Dayton positions, elected and civil, will be eliminated upon dissolution, except for certain public works positions that will be transferred (if eligible) to similar Town of Dayton positions . All Village Departments will be eliminated. • The Town of Dayton will create special districts to be governed by the Town Board and paid for by users of the individual systems: Water, Sewer, Sidewalk, Lighting. • The Town of Dayton will provide road and municipal property maintenance, code enforcement, zoning, Justice Court services, and operate the Village Library, Depot, Playground and Gazebo in accordance with current Village practices. • The Town of Dayton will not provide refuse and yard waste services, although yard waste drop off will continue. • All real property, personal property and vehicles owned by the Village of South Dayton at the time of dissolution will transfer to the Town of Dayton or special district. • Any Village of South Dayton fund balances that remain at the time of dissolution will transfer to the Town of Dayton. • The Town of Dayton will assume all staffing responsibility and most employees will be transferred to the Town of Dayton with similar titles and responsibilities. • Village of South Dayton laws, without equivalents in Town of Dayton laws, will remain in effect for two years following dissolution, during which time the Town of Dayton will review the laws and either adopt or void them. • The water and sewer system debt will be passed to the Town of Dayton and paid for by users of the water and sewer system special districts. The EPA stormwater improvement and DEC-ZEV charging station revenue anticipation notes will pass to the Town of Dayton; these debts should be fully reimbursed through grants. • If the Village of South Dayton dissolves, the property tax burden on Village properties would decrease from a current total Town and Village government tax burden of approximately $18.40 per $1,000 to an estimated $5.00 per $1,000, assuming 100% of the Citizen Empowerment Tax Credit is applied to reduce taxes for all Town taxpayers. • However, Village residents are projected to see a 33% increase in Water and Sewer fees. Residents would need to secure their own refuse and yard waste services. With those increased costs, the average property receiving water and sewer services would still see an overall savings of about $100 per year. • This modeling does not take into account other property taxes such as those levied by Cattaraugus County, the school district, or the fire district. • The effective date of the proposed dissolution would be May 31, 2027. After the Public Hearing, the Village Board will have up to 180 days to amend and adopt the Final Dissolution Plan. According to the current process timeline, if the Final Plan is adopted, registered voters residing in the Village of South Dayton will vote on the proposed plan in public referendum on June 9, 2026. If the referendum passes, the Village of South Dayton will dissolve on May 31, 2027.
