GENESEE COUNTY LEGAL NOTICE BYRON-BERGEN CENTRAL SCHOOL DISTRICT NOTICE OF ANNUAL HEARING, BUDGET VOTE AND ELECTION NOTICE IS HEREBY GIVEN, that pursuant to a resolution of the Board of Education, that a public hearing of the qualified voters of the Byron-Bergen Central School District, Genesee County, Bergen, New York, will be held in the Jr/Sr High School Auditorium in said District on Thursday, May 7, 2026 at 6:00 PM prevailing time, for the presentation of the budget. AND FURTHER NOTICE IS HEREBY GIVEN, that a copy of the statement of the amount of money which will be required to fund the School District budget for 2026-27, exclusive of public monies, may be obtained by any resident of the District during business hours beginning Thursday, April 30, 2026, except Saturday and Sunday, at the District Office and office of any school in the District, or on the School’s website at www.bbschools.org. AND FURTHER NOTICE IS HEREBY GIVEN, that the annual meeting of the qualified voters of the Byron-Bergen Central School District will be held on Tuesday, May 19, 2026 from 11:30 AM to 8:30 PM prevailing time in the Byron-Bergen Sr High School Gymnasium, at which time the polls will be opened to vote by ballot or machine upon the following items: Proposition #1 - RESOLVED that the proposed budget of expenditures of the Byron-Bergen Central School District for the school year 2026-27 and for the purposes shown in the statement of estimated expenditures adopted by the Board of Education, be and the same hereby is approved and the amount thereof shall be raised by a levy of a tax upon the taxable property of the school district, after first deducting the monies available from State Aid and other sources as provided by law. Proposition #2 – RESOLVED that the Board of Education of the Byron-Bergen Central School District is hereby authorized to acquire two (2) 70 passenger buses and one (1) minivan bus at a cost not to exceed $408,500, which is estimated to be the maximum cost thereof, to expend such sums for such purpose, levy the tax necessary therefore, to be levied and collected in annual installments in such years and in such amounts as may be determined by the Board of Education, taking into account state aid received, and in anticipation of the collection of such tax, to issue bonds and notes of the District at one time or from time to time, or enter into a lease-purchase agreement to acquire said vehicles. AND FURTHER NOTICE IS HEREBY GIVEN to elect two members of the Board of Education to 3-year terms to begin on July 1, 2026 and expire on June 30, 2029 to replace Lisa Forsyth and Cindy Matthews whose terms expire on June 30, 2026. Petitions nominating candidates for the office of member of the Board of Education must be filed with the District Clerk no later than 5:00 PM on April 20, 2026 (all other days prior to that date between 8:00 AM and 3:30 PM). AND FURTHER NOTICE IS HEREBY GIVEN that applications for early ballots will be obtainable between the hours of 8:00 AM and 3:30 PM Monday through Friday, except holidays, at the Office of the Board Clerk. Applications for early ballots are also available from the Board Clerk, via e-mail at taxcollector@bbschools.org. To receive an early ballot application, name, residence address, phone number must be provided and the application must state that the voter is or will be a qualified voter of the School District on the day of the election. Completed applications must be received by the Board Clerk at least seven (7) days before the election if the ballot is to be mailed to the voter, or the day before the election, if the ballot is to be delivered personally to the voter. Completed early ballots must be received by the Board Clerk not later than 5:00 PM, prevailing time, on Tuesday, May 19, 2026. AND FURTHER NOTICE IS HEREBY GIVEN that military voters who are qualified voters of the District as defined by Part 122 of the Commissioner’s regulations may apply for a military ballot by requesting an application from the Board Clerk. For a military voter to be issued a military ballot, the Board Clerk must have received a valid ballot application no later than 5:00 pm on April 22, 2026. In a request for a military ballot application or ballot, the military voter may indicate their preference for receiving the application or ballot by mail, facsimile transmission or electronic mail. A list of persons to whom early ballots are issued will be available for inspection to qualified voters of the District in the office of the Board Clerk on and after Wednesday, May 13, 2026 between the hours of 8:00 AM and 3:30 PM on weekdays prior to the day set for the annual election and on Tuesday, May 19, 2026, the day set for the election, and said list will be posted at the polling place at the election. AND FURTHER NOTICE IS HEREBY GIVEN that the qualified voters of the School District shall be entitled to vote at said annual vote and election. A qualified voter is one who is (1) a citizen of the United States of America, (2) eighteen years of age or older and (3) a resident within the School District for a period of thirty (30) days preceding the annual vote and election. The School District may require all persons offering to vote at the budget vote and election to provide one form of proof of residency pursuant to Education Law Sec. 2018-c. Such form may include a driver’s license, a non-driver identification card, a utility bill, or a voter registration card. Upon offer of proof of residency, the School District may also require all persons offering to vote to provide their signature, printed name and address.
