EDEN CENTRAL SCHOOL DISTRICT EDEN, NEW YORK DISTRICT OFFICE March 31, 2026 WHEREAS, pursuant to Sections 1716 and 2004 of the Education Law, it is necessary to provide for publication of the notice of the annual meeting and vote (the "Annual Vote") of the Eden Central School District (the "District"), as well as notice of the budget hearing of the District; follows: NOW, THEREFORE, BE IT RESOLVED by the Board of Education (the "Board") of the District, as (1) that the provisions of this resolution shall be effective regardless of anything to the contrary in the Board Policy Handbook, or minutes of previous Board meetings, or otherwise; (2) that the public hearing for the qualified voters of the District on the proposed 2026-2027 budget shall be held on Monday, May 11, 2026 at 6:00 p.m. prevailing time in the Eden Middle and High School Library, 3150 Schoolview Rd., Eden, New York 14057; (3) that, pursuant to Section 2002 of the Education Law, the Annual Vote shall be held on Tuesday, May 19, 2026, from 9:00 a.m. to 9:00 p.m. at the Eden Central Middle and High School, 3150 Schoolview Road, Eden, New York 14057, for the purpose of: (1) voting on the appropriation of the necessary funds to meet the District's estimated expenditures for the fiscal year commencing on July 1, 2026 and ending on June 30, 2027; (2) electing two (2) members of the Board; (3) voting on use of a capital reserve fund for the acquisition of school buses; (4) voting on the establishment of a capital project reserve fund; and (5) for the transaction of such other business as may be authorized by law or rules of the Board. EDEN CENTRAL SCHOOL DISTRICT NOTICE OF ANNUAL MEETING & ELECTION NOTICE IS HEREBY GIVEN, that the annual meeting and vote (the "Annual Vote") of the Eden Central School District, Erie County, New York (the "District") shall be held on Tuesday, May 19, 2026 from 9:00 a.m. to 9:00 p.m. at the Eden Central Middle and High School, 3150 Schoolview Road, Eden, New York, to vote, by paper ballot or voting machine, for the purposes of: (1) electing two (2) members of the Board of Education (the "Board"), (2) voting on the District's proposed budget for the 2026-2027 fiscal year; (3) voting on the purchase and financing of school vehicles; (4) voting on the establishment of a capital project reserve fund; and (5) for the transaction of such other business as may be authorized by law or rules of the Board. TAKE FURTHER NOTICE, that a public hearing of the qualified voters of the District will be held on Monday, May 11, 2026 at 6:00 p.m. at the Eden Middle and High School Library, 3150 Schoolview Rd., Eden, New York for the presentation of the District's 2026-2027 budget. TAKE FURTHER NOTICE, that the Board will have prepared and completed a detailed statement in writing of the amount of money that will be required during the District's 2026-2027 fiscal year for school purposes, specifying the several purposes and the amount for each. Such statement will be available for review, upon request, to residents within the District at each of the offices in the public schoolhouses of the District and in the Eden Public Library from 9:00 a.m. to 3:00 p.m. between April 21, 2026 and May 18, 2026, exclusive of Saturdays, Sundays and holidays, and on the day of the Annual Vote. TAKE FURTHER NOTICE that the qualified voters of the District shall be entitled to vote at said Annual Vote. A qualified voter is one who is (1) a citizen of the United States of America, (2) eighteen (18) years of age or older, (3) resident within the District for a period of thirty (30) days next preceding the Annual Vote and (4) not otherwise disqualified from voting in school district elections. The District may require all persons offering to vote at the Annual Vote to provide one form of proof of residency pursuant to Education Law Section 2018-c. Such form may include a driver's license, a non-driver identification card, a utility bill or a voter registration card, upon offer of proof of residency the District may also require all persons offering to vote to provide their signatures, printed names and addresses. TAKE FURTHER NOTICE, that all candidates for the office of member of the Board shall be nominated by petition. Each petition shall be directed to the District Clerk, shall be signed by at least twenty-five (25) qualified voters of the District, shall state the residence of each signer, and shall state the name and residence of the candidate. Each petition shall be filed in the office of the District Clerk between the hours of 9:00 a.m. to 3:30 p.m., but not later than 5:00 p.m. on April 20, 2026. Nominating petitions may be obtained in the office of the District Clerk located at 8289 North Main Street, Eden, New York, between the hours of 9:00 a.m. to 3:30 p.m., Monday through Friday, excluding holidays. TAKE FURTHER NOTICE, that an election for members of the Board shall be held to fill two (2) at-large positions on the Board as follows: (1) a vacancy created by the resignation of an incumbent prior to the expiration of his/her term; and (2) one vacancy created by the expiration on June 30, 2026, of the term of Cheryl Carpenter. The candidate with the highest vote total will serve a term commencing on May 20, 2026 and ending on June 30, 2029. The candidate receiving the second highest vote total will serve a three-year term beginning on July 1, 2026 and ending on June 30, 2029. TAKE FURTHER NOTICE that pursuant to District Policy 1220, voting machines will be used to record the vote on the budget, on all propositions, and on the election of the member(s) of the Board. TAKE FURTHER NOTICE, that pursuant to a rule adopted by the Board under §§2035 and 2008 of the Education Law, any referenda or propositions to amend the budget, or otherwise to be submitted for voting at the Annual Vote must comply with the Board's adopted rules set forth in District Policy 1650. However, the Board will not entertain any petition to place before the voters any proposition the purpose of which is not within the powers of the voters to determine, or any proposition which fails to include a specific appropriation where the proposition requires the expenditure of monies. Printed copies of the policy are available at the office of the District Clerk. TAKE FURTHER NOTICE, that applications for absentee and early mail ballots for the Annual Vote may be obtained at the office of the District Clerk in the District Office, 8289 North Main Street, Eden, New York. Completed applications must be received by the District Clerk at least seven (7) days before the Annual Vote, if the ballot is to be mailed to the voter, or on the day before the Annual Vote, if the ballot is to be issued personally to the voter at the office of the District Clerk. All completed absentee ballots and early mail voting ballots must be received by the District Clerk not later than 5:00 p.m. on May 19, 2026, (the day of the Annual Vote) to be canvassed and counted. A list of all persons to whom absentee and early mail ballots shall have been issued will be available in the office of the District Clerk, where it shall be open for inspection by any qualified voter of the District, between the hours of 8:00 a.m. and 3:30 p.m. at least five (5) days before the Annual Vote until the day set for voting, except for Sundays. Such list will also be available at the polling place on the date of the Annual Vote. Any qualified voter may challenge the acceptance of an absentee or early mail ballot of any person on such list by making the challenge and the reasons therefore known to the Inspector of the Election before the close of the polls. TAKE FURTHER NOTICE, that military voters who are qualified voters of the District may apply for a military ballot by requesting an application from the District Clerk at the District Clerk's office located at 8289 North Main Street, Eden, New York, between the hours of 9:00 a.m. and 3:30 p.m., Monday through Friday, exclusive of holidays. For a military voter to be issued a military ballot, the District Clerk must have received a valid ballot application no later than 5:00 p.m. on April 23, 2026. In a request for a military ballot application or ballot, the military voter may indicate their preference for receiving the application or ballot by mail, facsimile transmission or electronic mail.
