On a motion made by Trustee Mitchell, seconded by Trustee Kim and unanimously carried, the following resolution was approved. Approved: 7-0 Local Law to amend Chapter 1 Penalties WHEREAS, under the Tarrytown Village Code, numerous provisions of the Village Code include references to Chapter 1, Article II of the Village Code, regarding penalties, and such provision and section of the Village of the Village Code has not been updated since 1991; and WHEREAS, since Chapter 1, Article II has a maximum penalty of $250 per day, many individuals or businesses choose to violate various provisions of the Village Code and pay the penalty as a cost of doing business, rather than seeking to comply with the provisions of the Village Code; and WHEREAS, the sections of the Village Code that provide for penalties pursuant to Chapter 1, Article II include the following chapters: Auctions and Auctioneers Chapter 81 Building Construction Chapter 97 Buildings, Moving of Chapter 101 Burning, Outdoor Chapter 109 Circuses and Carnivals Chapter 113 Collateral Loan Brokers Chapter 117 Dogs and other Animals Chapter 125 Dry Cleaning and Laundry Establishments Chapter 133 Electrical Standards Chapter 139 Excavations Chapter 139 Firearms Chapter 161 Fire Prevention Chapter 165 Garbage, Rubbish and Refuse Chapter 183 Graffiti Chapter 185 Helicopters Chapter 187 Landscaping Chapter 205 Licensing Chapter 209 Parades and Special Events Chapter 218 Parking System, Residential Chapter 220 Parks and Recreation Areas Chapter 221 Peddling and Soliciting Chapter 225 Sidewalk Cafes Chapter 247 Article 1 Streets and Sidewalks Chapter 259 Article 1 Excavations in Streets Streets and Sidewalks Chapter 259 Article XIII Removal of Snow and Ice Theaters Chapter 277 Water Chapter 297, Article III Cross Connection Program Waterfront Consistency Review Chapter 300 Zoning Chapter 305 AND, WHEREAS, the Village would like to include Chapter 215 on Noise under the provisions of Chapter 1, Article II regarding penalties; and WHEREAS, the Village would like to correct a ministerial reference in Chapter 125 on Dogs and other Animals to change the reference in Section 125-2, Part C from 125-3 so that it is updated to refer to Chapter 125-4 on Penalties for Offenses; and WHEREAS, the Village would like to update the references in the Code Chapter 251 regarding Signs, to update the minimum penalty to “at least $250”; and WHEREAS, in cases where certain real property is not properly maintained, the Village needs to amend the provisions of the Village Code under Chapter 259-38 so that the unpaid costs and charges for cleaning or removing snow and/or ice if not paid for more than a year shall be added to the Village tax roll and collected as taxes, and also to delete Section 259-38 B requiring a hearing on justness of the imposition of such charges. WHEREAS a notice of public hearing was posted in the Journal News on March 20, 2026to consider the adoption of Local Law 02-2026 to amend General Provisions, Chapter 1, Article II regarding Penalties; Chapter 125 on Dogs and other Animals; Chapter 215 on Noise; Chapter 251 on Signs; Chapter 259 on Streets and Sidewalks, Article XIII Removal of Snow and Ice, to amend and update various provisions of the Village Code on Penalties; and WHEREAS a public hearing on Local Law 02-2026 to amend and update various provisions of the Village Code on Penalties was held on April 6, 2026; and WHEREAS, the Board of Trustees hereby determines that the action is not subject to the State Environmental Quality Review Act as it will not affect the environment. NOW, THEREFORE, BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown does hereby adopt Local Law 02-2026 which amends General Provisions, Chapter 1, Article II regarding Penalties; Chapter 125 on Dogs and other Animals; Chapter 215 on Noise; Chapter 251 on Signs; Chapter 259 on Streets and Sidewalks, Article XIII Removal of Snow and Ice, to amend and update various provisions of the Village Code on Penalties; and BE IT FURTHER RESOLVED that the Board of Trustees authorizes the Village Administrator to implement any necessary procedures relevant to Local Law 02-2026. 12247888
