You are hereby notified that on the 5th day of February 2026, Ruby M. Smith filed in this Court a Complaint for Custody of Grace Smith, a minor, whose date of birth is 07/01/2022. This Court, located at 110 Central Plaza South, Canton, Ohio 44702, will hear the matter on the 30th day of March 2026, at 10 o'clock A.M.
If you are the biological father and wish to establish parental rights, you must take action to do so, including possible genetic testing pursuant to Ohio Revised Code § 3111.38. You are required to file an Answer or responsive pleading within 28 days of this Notice. All pleadings must be filed with the Clerk of Courts, Stark County Court of Common Pleas, 110 Central Plaza South, Suite 210, Canton, Ohio 44702, with a copy served upon Teresa R. Fout, Fout Law Office LLC., 610 North Main Street, North Canton OH 44720, Attorney for Petitioner.
IF YOU FAIL TO APPEAR OR FILE A RESPONSE, judgment may be entered against you by default, and the Court may grant custody to a non-parent, establish child support obligations, and allocate parental rights and responsibilities without your input. Pursuant to Ohio Revised Code § 3109.042, you may have rights to assert regarding the custody and care of the minor child. It is alleged in the petition, pursuant to ORC § 3109.042, that the consent of John Doe is not required. You have the right to be represented by an attorney.
