Fithen, as of January 8, 2025, whose identities and places of residence are unknown and cannot by reasonable diligence be ascertained, will take notice that on the 23rd day of January, 2026, Plaintiff, Peoples Bank, successor in interest by merger to The National Bank and Trust Company, filed its Complaint for Foreclosure (In Rem) against the Unknown Heirs, Devisees, Legatees, Administrators, Executors, Assigns and Estate of Justin A. Fithen, Deceased; and Jane Doe, Unknown Spouse, if any, of Justin A. Fithen, as of January 8, 2025, and others, in the Court of Common Pleas of Brown County, Ohio, the same being Case No. 20260061, representing among other things that there is due on a 12 Year Home Equity Revolving Loan (the "Note") the sum of $35,147.19, plus interest at the per diem rate of $8.29 from December 10, 2025, plus court costs, advances, and other charges as allowed by law; that as security for the payment of said Note, on December 1, 2011, Justin A. Fithen (now deceased), executed a Mortgage to The National Bank and Trust Company, now Peoples Bank, which was recorded on December 8, 2011, in O.R. Book 409, page 1978 et seq., of the Official Records of Brown County, Ohio; and thereupon became the first lien upon the real estate located at 315 E. Grant Avenue, Georgetown, Ohio 45121 (Parcel No. 33-065992.0000) (the "Property").Plaintiff Peoples Bank, successor in interest by merger to The National Bank and Trust Company, prays that the Court determine that it is owed the amount of $35,147.19, plus interest at the per diem rate of $8.29 from December 10, 2025, plus court costs, advances, and other charges as allowed by law; thatits mortgage be foreclosed and the liens marshaled; that the equity of redemption of the Defendants be foreclosed; that the Property be sold and the amount due the Plaintiff, Peoples Bank, be paid from the proceeds of said sale according to its priority, together with its costs therein, and that all Defendants be required to set up their claims or interests in the Property, or be forever barred.
