LEGAL NOTICENotice of Estimated Assessment The Board of Trustees of the Southern 5 Sewer District hereby gives notice upon the following owners of certain identified real property within the unincorporated community of Celeryville located in New Haven and Richmond Townships in Huron County, Ohio of the passage on March 18, 2026 of a Resolution of Necessity for the Celeryville Wastewater Collections System Project and also of the filing of estimated assessments, under Section 6119.25 of the Ohio Revised Code, upon the following properties: Graham Real Estate Postema LLC4252 Postema CtEst. Assessment: $50,469.93 Graham Real Estate Postema LLC4262 Postema CtEst. Assessment: $50,469.93 Debra Wiers Hutchinson4141 Broadway RdEst. Assessment: $16,823.31On March 18, 2026, the Board of Trustees of the Southern 5 Sewer District (herein, the “District”), adopted a Resolution of Necessity for the construction of a sanitary sewer system within the unincorporated community of Celeryville in Huron County, Ohio (the “Project”). The District declared it necessary for the preservation and promotion of the public health, safety and welfare, and determined that special assessments will be levied to collect certain costs of the Project. Your property is to be assessed for such improvements. The assessments applicable to your property are set forth in the list above. Design of the Project is now complete and plans, specifications, and profiles of the proposed Project showing the anticipated grade of the Project after completion, along with an estimate of costs of the Project, are on file in the office of the Secretary of the Board of Trustees of the District, 631 S. Myrtle Avenue, Willard, OH 44890. Estimated assessments have been determined for the properties to be benefited by the Project and are also on file in the office of the Secretary of the Board of Trustees at the above address. These documents are open to inspection of all persons with an interest therein. At a later date, the final assessments will be prepared after the actual costs of the Project have been ascertained, and property owners will be given notice, by mail, of the final assessment amount. Property owners will then be given the opportunity to pay their assessment within 30 days after the notice of final assessments is provided, or to pay the assessment over a minimum period of 30 years. Please note the following: 1. An assessment methodology based on benefit shall be used to equitably distribute the costs in proportion to the benefit conferred. That assessment methodology for the Project shall levy an assessment which shall equal the property owners' portion of certain construction costs (“Cost”) according to the level of sanitary sewer service provided to the property. The total sum of the Cost of the Project shall be divided among the parcels with improvements (“Improvement Assessment”) which will connect to the public sanitary sewer system in accordance with the level of service required. All single-family homes will be treated the same with regard to the level of service provided and their assessments will be the same. Multi-family homes, commercial establishments, schools, and churches will be assessed an amount greater than a single-family home, which amount will vary depending on the level of service required as determined by the District's engineer. 2. These assessments shall be levied over a minimum period of 30 years provided, however, that property owners shall be given 30 days after adoption of the Resolution of Assessment to pay such assessments in full. If you choose to pay the assessment over the term of the loan, which is a minimum period of 30 years, your payments for a single family house are estimated to be about $280.38 for each parcel with improvements, payable on your property taxes twice per year. If you choose to pay your assessment as a lump sum upon completion of construction of the Project, your estimated Improvement Assessment is $16,823.31 for a single family house. Please bear in mind that these figures are only estimated amounts based on the project estimates assessed over a 30-year period. Final assessments, which are calculated after the final costs of the Project have been ascertained, may be higher or lower than estimated. 3. The owner of any unimproved property within the Project area who improves said property and wishes to connect such improvement to the Celeryville sanitary sewer collection system hereafter constructed, or the owner of any property not within the area described and identified as the Project area who wishes to connect such property to the sanitary sewer collection system hereafter constructed, shall, prior to making any connection and prior to receipt of a permit to do so, pay any applicable connection or tap fee to the District as set forth in the District's Regulations or charge schedule, which said sum shall not be less than the amount that would have been assessed if the property had been assessed according to the methodology described above. Any objections to this estimated assessment must be filed, in writing , within 28 days of receipt of this notice. Objections must be filed with the Secretary of the Board of Trustees, 631 S. Myrtle Avenue, Willard, OH 44890, or such objection will be waived. Under Ohio Revised Code Sections 6119.48 and 6119.49, your right to object is limited to objections to your assessment . An objection that you are opposed to the Project in general is not an objection to your assessment , and therefore is not a valid objection under Sections 6119.48 and 6119.49. Any correspondence from you which is intended as an objection must state an objection or it will be deemed a comment, not an objection, by the District. Any objection must also clearly include the address where you want future notices regarding this matter to be provided. Any objection will result in the District appointing an assessment equalization board to hear your objection in accordance with Ohio Revised Code Section 6119.49 and make recommendations to the District regarding the amount of your assessment. Costs related to objections will be added to the costs of the Project and assessed to all property owners along with the other costs of the Project.
