LEGAL NOTICE PURSUANT TO OHIO REV. CODE § 1715.39
Notice is hereby given that St. John's Evangelical Lutheran Church of Perrysville, Ohio ("St. John's") has filed a Petition in the Court of Common Pleas of Ashland County, Ohio pursuant to Ohio Revised Code Section 1715.39. The object of said Petition is to obtain an Order from the Court authorizing St. John's to sell the real property located at 111 E. 2nd Street, Perrysville, Ohio 44864, in Ashland County, Parcel No. B07-058-0-0022-00 (the "Property") at public auction. The Petition alleges that St. John's is entitled to sell the Property as the successor in interest to an unincorporated association that obtained title to the Property in 1897.
The Prayer of said Petition is for the Court to:
(A) Set this matter for hearing at the earliest practicable date; (B) After notice and hearing, find that the proposed sale of the Property by auction is desired by members of Petitioner and that it is proper that authority be given to Petitioner to accomplish the sale; (C) After notice and hearing, issue an order authorizing Petitioner to sell the Property at public auction, pursuant to the terms set forth above; (D) Approve the distribution of the proceeds of the sale to cover costs related to this action and winding up the Church, including legal fees; and (E) Grant such other and further relief as the Court deems just and proper.
Any person or entity claiming an interest in the subject matter of this Petition may appear and file an answer thereto within the time allowed by law. This matter will be scheduled for a hearing before the Court on a date not less than four weeks from April 11, 2026.
