Public NoticeORDINANCE NO. 725AN ORDINANCE OF THE CITY OF FRUITLAND, IDAHO, REPEALING CHAPTER 4 OF TITLE 3 OF THE FRUITLAND CITY CODE ENTITLED “OPEN AIR MARKETS,” WHICH HAS BEEN REPLACED BY CHAPTER 10, “SPECIAL EVENT PERMITS”; AND PROVIDING AN EFFECTIVE DATE.WHEREAS , the City of Fruitland previously adopted Chapter 4 of Title 3 of the Fruitland City Code regulating “Open Air Markets”; andWHEREAS , the City has since adopted Chapter 10 of Title 3 establishing regulations for “Special Event Permits,” which encompasses and regulates activities previously addressed under “Open Air Markets”; andWHEREAS , the City Council finds that maintaining both chapters is duplicative and may create confusion for applicants and staff; andWHEREAS , the City Council has determined it is in the best interest of the City to repeal Chapter 4 of Title 3 in order to consolidate regulations under Chapter 10;NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF FRUITLAND, IDAHO:Section 1. Repeal.Chapter 4 of Title 3 of the Fruitland City Code, entitled “Open Air Markets,” is hereby repealed in its entirety. Section 2. Intent.It is the intent of the City Council that activities previously regulated under Chapter 4 of Title 3 shall be regulated under Chapter 10, “Special Event Permits,” as applicable. Section 3. Severability.If any section, subsection, sentence, clause, or phrase of this ordinance is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portions of this ordinance. Section 4. Repealer Clause.All ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 5. Effective Date.This ordinance shall be in full force and effect upon its passage, approval, and publication as provided by law.PASSED BY THE CITY COUNCIL AND APPROVED BY THE MAYOR OF THE CITY OF FRUITLAND, IDAHO, this 27 th day of April, 2026. ss.
