NOTICE OF PUBLIC HEARING AND INTENT TO ENACT ZONING ORDINANCE AMENDMENT FOSTER TOWNSHIP, LUZERNE COUNTY, PENNSYLVANIA NOTICE is hereby given that the Board of Supervisors of Foster Township will hold a public hearing on March 11, 2026 at 6:00 p.m. at the Foster Township Municipal Building, located at 1000 Wyoming Ave., Freeland, PA, to consider public comment on a proposed amendment to the Foster Township Zoning Ordinance. The Board of Supervisors further gives NOTICE of its intent to consider adoption of the proposed ordinance at a public meeting on March 11, 2026 at 6:00 p.m., at the same location. The title and a brief summary of the proposed ordinance are as follows: ORDINANCE NO. 2026 AN ORDINANCE OF FOSTER TOWNSHIP, LUZERNE COUNTY, PENNSYLVANIA, AMENDING THE FOSTER TOWNSHIP ZONING ORDINANCE, ARTICLE 5, SECTION 501 ZONING DISTRICT REGULATIONS, AND ARTICLE 8 SUPPLEMENTAL REGULATIONS, TO DEFINE AND REGULATE DATA CENTERS AND DATA CENTER ACCESSORY USES The proposed ordinance amends the Foster Township Zoning Ordinance as follows: 1.Adds definitions for “Data Center” and “Data Center Accessory Use” to Article 2, Section 203. 2.Permits Data Centers and Data Center Accessory Uses as a Conditional Use in the AEO Alternate Energy Overlay. 3.Creates Section 801.52 establishing specific standards for Data Centers, including but not limited to: oDimensional requirements; oRequired landscape buffers and screening; oEquipment enclosure and fencing standards; oNoise and vibration limits supported by professionally prepared studies; oWater supply and wastewater disposal requirements, including feasibility studies and DRBC approvals where applicable; oElectrical service requirements; oEmergency response planning and fire-safety standards; oRequirements for fuel storage & standby generators oRequired documentation showing continued compliance with state permits/approvals; 4.Contains severability, repealer, codification, and effective date provisions. A complete copy of the full text of the proposed ordinance is available for public inspection at the Foster Township Municipal Building during regular business hours.
