BOROUGH OF FREELAND MUNICIPAL AUTHORITY The Borough of Freeland Municipal Authority (FMA), in accordance with the Federal Regulation Section 403.8(f)(2)(viii), hereby publishes its list of Significant Industrial Users in Significant Noncompliance with regard to the Industrial Pretreatment Program during 2025. INDUSTRY NAME and ADDRESS - Citterio USA Corporation, 2376 State Route 940, Freeland, PA 18224. VIOLATION - Incurred the following violations and infractions of FMA's pretreatment program: Exceeded the permitted Flow monthly average limit (specified in Part I-A(2)(a) of Industrial Wastewater Discharge [IWD] Permit No. 2) during the first, second, third, and fourth quarters of 2025 (Chronic Violations). Exceeded the permitted Ammonia monthly average limit (specified in Part I-A(2)(a) of IWD Permit No. 2) during the first, third, and fourth quarters of 2025 (Technical Review Criteria [TRC] violations) and during the third and fourth quarters of 2025 (Chronic Violations). Exceeded the permitted Biochemical Oxygen Demand (BOD) monthly average limit (specified in Part I-A(2)(a) of IWD Permit No. 2) during the first, second, third, and fourth quarters of 2025 (Chronic Violations and Technical Review Criteria [TRC] violations). Partial failure to develop and maintain (as required) an approved Spill Prevention Control and Countermeasure (SPCC) Plan. Incurred a total of eighteen (18) Notices of Violation (NOVs) issued by FMA. NOV content predominantly includes, yet is not limited to, the following: Recurring permit parameter exceedances - Flow, Ammonia, Biochemical Oxygen Demand (BOD), Total Dissolved Solids (TDS), intermittent pH, etc. SCHEDULE OF COMPLIANCE - Citterio USA Corporation has demonstrated improved effective action in terms of achieving compliance with FMAs pretreatment program. FMA has engaged Citterio USA Corporation and their consultants through a series of sit-down/virtual meetings and will continue to work with Citterio USA Corporations management towards compliance with FMA's pretreatment program. Specifically, Citterio USA Corporation and FMA are actively negotiating a Global Infrastructure (Consent Order) Agreement to be put in place in 2026. IMPACT - The FMA Wastewater Treatment Facility experienced certain interference in 2025 upon receipt of slug load(s) of grease-laden industrial wastewater from Citterio USA Corporations process wastewater discharge, during such uncontrolled pretreatment slug/spill events. Adverse impacts have been known to affect FMA's dewatering operations, efficiencies, solids schedule, and/or influent pH, etc. FMA will continue to closely monitor/evaluate parameters of concern in Citterio USA Corporations process wastewater discharge volumes (relative to instances of potential adverse impact at FMAs facility). This further includes Ammonia, BOD, and TDS.
