BOROUGH OF ST. LAWRENCE BERKS COUNTY, PENNSYLVANIA ORDINANCE NO. 462 AN ORDINANCE FOR THE BOROUGH OF ST. LAWRENCE TO GRANT THE BOROUGH MANAGER AUTHORITY REGARDING THE HIRING, SUPERVISION, AND DISCHARGE OF EMPLOYEES; REPEALING PRIOR INCONSISTENT ORDINANCES OR PARTS OF ORDINANCES; CONTAINING A SEVERABILITY CLAUSE; AND SETTING AN EFFECTIVE DATE. WHEREAS, the Borough Council of the Borough of St. Lawrence desires to ensure the efficient day-to-day administration of Borough affairs; and WHEREAS, the Borough Code authorizes Council to delegate non-legislative duties to a Borough Manager by ordinance. NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the Council of the Borough of St. Lawrence, and it is hereby ordained and enacted by the authority of the same: SECTION 1. Authority Over Personnel The Borough Manager, as the chief administrative officer of the Borough, shall have the authority to manage all Borough personnel, subject to the limitations set forth herein. SECTION 2. Specific Powers to Hire and Fire The Borough Manager shall have the power and duty to: 1. Hire and Appoint: Hire all non-elected, non-appointed municipal employees under their supervision, subject to final approval by Borough Council. 2. Supervise: Direct, control, and evaluate the work, services, and performance of all employees under their supervision. 3. Discipline and Discharge: Suspend any employee with pay under their supervision when the Manager deems it necessary. Terminations will be the final decision of Council, with suspension with pay being at the discretion of the Borough Manager until the final decision is made. SECTION 3. Limitations and Exceptions The authority granted in Section 2 is subject to the following limitations: 1. Statutory Offices: This authority does not extend to offices required by law to be filled by direct action of Council (e.g., Solicitor, Treasurer, Secretary, if appointed separately). 2. Council Approval: The Manager shall recommend hiring/firing to Council, but final decisions remain with Council. The Manager may immediately suspend an employee with pay until Council's final determination when he or she deems it necessary for due to risk of harm to persons or property or preservation of good order and discipline in the workplace. SECTION 4. Reporting Requirements The Borough Manager shall report to Council at the next regular meeting thereafter regarding any significant action taken under this authority, particularly regarding hiring and discharges. Any immediate action that cannot wait until the next regular meeting, the Borough Manager will request a special meeting of Council with advertisement required by law. All ordinances or parts of ordinances conflicting with this Ordinance are hereby repealed. This Ordinance shall become effective on March 10, 2026 RE Feb 23 A-1
