A brief statement of the nature of this suit is as follows, to-wit: Plaintiff, VARGAS & REYES, LLC, a Texas Limited Liability Company, sued Defendants, KENNETH H. SEBELIUS and ALLAN D. SEBELIUS, if living, or their estates and/or heirs, if any or all of the above-named are deceased, and any and all other persons, including adverse claimants, owning or having any legal or equitable interest or claim of title in, or lien upon the Subject Real Property for clear title and possession of the Subject Real Property, to clear Plaintiff’s title of any cloud cast by Defendants, their heirs, if any, and/or any and all adverse claimants owning or having any legal or equitable interest of claim of title in, or lien upon the Subject Real Property, and quieting Plaintiff’s title and possession to the Subject Real Property in the name of Plaintiff in and to the following: BEING 39.93 acres of land, more or less, being part of the Joaquin De La Garza Survey No. 1, Abstract No. 3, Atascosa County, Texas, said tract of land being that same tract of land described as containing 40 acres in a Deed to John B. O’Brien, et al., recorded in Book 275, Page 480, Official Public Records, Atascosa County, Texas, as is more fully shown by PLAINTIFF’S ORIGINAL PETITION on file in this suit.
