PUBLIC NOTICE OF APPLICATION FOR RELEASE OF RECLAMATION LIABILITYFOR SURFACE COAL MINING AND RECLAMATION PERMITPERMIT NO. 321 JEWETT MINE, LLC430.6-ACRE BOND RELEASEPHASE IDOCKET NO. MR-26-00030362Pursuant to Sections 134.128-.134 of the Texas Surface Coal Mining and Reclamation Act, TEX. NAT.RES. CODE ANN. CH. 134. (Vernon 2025) and the Texas Coal Mining Regulations, 16 TEXAS ADMIN.CODE §§12.312-12.313 (Thomson West 2025), Jewett Mine, LLC (JMLLC), of Jewett, Texas hassubmitted its application and supplement to the Railroad Commission of Texas for release of Phase Ireclamation performance bond obligations for portions of its Jewett Mine, Permit No. 321 in Limestone,Leon, and Freestone Counties, Texas. The Jewett Mine area is located approximately 5 miles northwest ofJewett, Texas. Permit No. 321 was most recently renewed on March 1, 2023.The applicant requests partial release of Phase 1-430.6 acres (Industrial/Commercial and Developed WaterResources) for backfilling, regrading, drainage control (60%). The areas requested occur in the C mineblock. Mining operations were conducted from 1986 - 2002 with regrading from 1988 to 2004 andrevegetation from 1990 to 2006. Revegetation was accomplished through seeding with Commonberrnudagrass, Klein grass, Switchgrass, Wilman lovegrass and Side-oats grama. Sixteen permanentstructures are located within the bond release areas including five (5) drop structures, two (2) diversions,three ponds (3) and six (6) roads.JMLLC currently has an approved total bond amount of $98,000,000.00. The applicant does not seekadjustment to the approved bond because of this application; however, an eligible bond reduction amountmay be determined.Interested persons are invited to submit written comments on the application within thirty days after the lastdate of publication of this notice in a local newspaper.
