NOTICE OF PUBLIC HEARING STERLING COUNTY UNDERGROUND WATER CONSERVATION DISTRICT Rulemaking Hearing for Proposed Changes and Increasing Export Fee March 09, 2026 at 1:00 p.m. Sterling County Underground Water Conservation District Office 612 4th Street, Sterling City, Texas 76951 The Sterling County Underground Water Conservation District (SCUWCD) will hold a public hearing on proposed Rules of the SCUWCD on Monday, March 9, 2026 at 1 pm at the SCUWCD office 612 4th Street, Sterling City, Texas. A description of proposed changes includes: 1. Removal of references to “fax” throughout the Rules 2. Section 3: Well Registration and Permits • Rule 3.204 Permit Application Requirements i. Added a permit application requirement to Rule 3.204(b) ii. Added clarifying language regarding the hydrogeological report required by Rule 3.204(c) • Rule 3.205 Permit Evaluation i. Added wells able to be considered under Rule 3.205(c) in accordance with Texas Water Code ? 36.113(d-2) 3. Section 5: Well Spacing and Production Limits • Updated Rule 5.202 to reflect how the District incorporates consideration of the DFC and monitoring of wells into the permit process 4. Section 6: Deposits and Fees • Increased the water export fee in Rule 6.103 and updated approved uses of those funds in accordance with Texas Water Code ? 36.122(e-1) 5.
